need help with claiming a child on taxs

If anyone can help me I've been looking on the IRS web site and cant find it
who can claime a child as a dependent??

Long story short, the biological father wants to claime her because i am not working right now, But my husband can claime her , she lives with us and we provide everything for her. The biological father gives support money when ever (meaning not consistent and not even the correct amount)

I found this on ask.com but need it from the irs sight to prove it to him:

Relationship — the person must be your child, step child, adopted child, foster child, brother or sister, or a descendant of one of these

Residence — for more than half the year, the person must have the same residence as you do.

Age — the person must be

Support — the person did not provide more than half of his or her own support during the year

First, the main thing is you know you both cant claim her.

Certainly your hub can claim head of household.

YOU and your hub prob have the legal right to claim your child. DONT take that as the gospel, but is prob true.

The main thing is to ask an accountant, or someone who KNOWS. If you have a legal right and your X claims her, he will get in trouble, not you.

But ask a tax expert before you do ANYTHING.

he has tryed this in the past. He field his taxes 1st and clamed her then I filled.
I had to prove that she lived with me and that I pay for most of her needs.
They gave me my credit and I dont know what happend to him

Whomever she is living with for more than half of the year has the legal right to claim her.
