These buyers are really PI**ING me off
We wanted to close June 30, to give us enough time to finish the new house, so that it would be an easy transition for the kids.
Noooo, they are pregnant at due at the end of June so they insisted on an earlier closing. We said, ok, June 15.
Noooo, has to be June 10.
Ok, we sign the papers and all is good.
Inspections are done, and we amend the contract, and they now demand June 7. Fine, fine, fine, we acquiesce, even though it's really not ideal for us with the kids.
So, I just found out that my daughter's graduation ceremony from preschool is the same day of the closing. It's a big, BIG deal, and I refuse to miss it - she has been at this school for over 5 years, and this is her second home at this point!
So, I emailed the realtor and said, look, I know the closing is June 7th, but we have this ceremony in the morning, so can we please schedule the closing for the afternoon.
No big surprise... the buyers REFUSE. They are coming in from out of town and spending the whole day/night here, so why the freak can't they be just a smidge accomodating and do the closing in the afternoon?
I've had it! I'm soooooo close to just pulling out of the deal!!

Do they have a lawyer?
Frankly I would tell them that you have been more than accommodating. They should not mistake your kindness for stupidity.
I would let them know that you do not "have" to sell your house and there needs to be some flexibility on their part.

ITA I was thinking the same thing! We had to sched our closing based on when the lawyers were available. Just tell your lawyer what works for you. We didn't sched the closing date. The lawyers did so just say when you're NOT available and then let the lawyers duke it out. You can postpone the date too if you want. You have till a certain date anyway so if the 7th doesn't work with the lawyers then so be it and work with the 8th sorry you're going through this, but you have been more than accomodating.

I can totally understand why you are angry. I am sorry this is so stressful for you! I wouldn't budge on this one. Tell them absolutely cannot be in the morning. If they want the house (which I am sure they do) they will deal with the afternoon or another day.

Ugh that is frustrating especially since you have been MORE than accomodating!
I think you should let the lawyers duke it out at this point. There is no reason they can't bend a few hours.

I agree with PP who said to tell your lawyer to relay the message that you have been more than accomodating to them. Be firm and tell them what works for you.

Why are you sweating this? Just put June 7th on the contract date. You should know as a lawyer you have at minimum 30 days afterwards to legally close.
There is no way they will have a morgage ready to close by then anyways. Their bank will hold them up.

i would flat out tell them that the time does not work for you. let them come up with another suggestion. day before? day after? after graduation?
you do not have to close at that exact time.

Beth, at this point you have no choice but to stand firm.
They have to give an inch. You have given yards.
They don't hold all the cards. If they can't be flexible by a few hours then that's their loss.
I think they need to buy this house more than you need to sell it.

That doesn't mean that its clear to close. Didn't you just agree two days ago? There is no way their bank is ready this fast. Doing things like title searches takes time.
And what are they going to do if not all the parties can agree to June 7th? What if the bank can't send somebody there that day? No bank lawyer means no closing.
I have bought and sold many properties before as well and I have never heard before of a date being set in stone more than a month away. Sounds really ridiculous.
But in the end you have to realize how badly do you want to sell to these people. If you got a great deal, then it might be time to just suck it up. Or just POA it with another attorney if you can't make the 7th.

I'd tell them if they can't do the afternoon of the 7th then you'll give them back the June 10 closing date they initially requested.

I was going to say the same thing. I wouldn't bend though. They're not gonna walk away from a house based on the time of closing so call their bluff! They're likely assuming since it's a "buyer's market" that you're at their mercy on every little thing but you're not and you've been more than accomodating already.

The OP is representing herself (she is the attorney). She would have to give power of attorney to somebody else to not be there.

and the time ususally changes 100 times till the actual day
I would just set it for the time you want- and if they don't like it- make for the next day

I agree. The contract closing date is an on or about date, not a firm date and time everyone must abide by. They are not the only parties necessary for closing. If you can't make it, you can't make it. Period. I have a haunch they will wait 4 hours, rather than lose the house. Depending on your state, you actually have a grace period after the closing date. I have a feeling a few hours is well within your state's grace period.
And if you really only accepted this offer a few days ago, I'd be shocked that they are cleared to close - clean title, survey, etc. Even if they are, just say you aren't available. Period. Don't ask - tell.

You should not have to miss your daughter's graduation for a closing that is being scheduled a month away!
I just closed on a new house today and the time was set for 2:00. We realized MONDAY that my son's soccer photo was at 5:00 so we rescheduled the closing for 12:00 to make sure we did not miss the photo shoot.
If the seller would have told us that we could not have rescheduled the closing for earlier in the afternoon, we would have adjourned the closing for another day......PERIOD!
You are the attorney - YOU call the shots.....Stand your ground and enjoy your daughter's graduation.....

I was going to say this also...we didn't go to the closing of our sale.

The process here is MUCH easier; we have closed on houses in less than a month after making an offer. And here, the closing date is basically set in stone, weeks in advance.
We worked something out so we can review the documents in advance, sign them, but don't have to be present. But, I'm still ticked off. So, I'm not leaving a lot of the stuff that I was planning on leaving for them, like the expensive pottery barn drapes in the living room and kitchen. That's what they get for bad karma!

I thought you had to leave the draperies.
I closed on houses in NC and it's SOOO much easier in other States. No flaky lawyer, postponned closing for whatever reason. It's really set in stone and that's it!
I would stick to the date/time you want. You were more than accomodating. Let's not push it!
