We only get 6 weeks unpaid leave from my company, we don't qualify for FMLA, so I was one of the unlucky ones that had to go back after 6 weeks.

This may be a dumb question but can you collect unemployment when you don't get paid for leave???



From my understanding no. Unemployment is for people willing, ready and able to work. Since you are on leave, you are unable to work therefore unable to collect unemployment.

However you can collect short term disability.

My friend works for NYCDOE as well and had her baby Sept. 5th. She HAD to go to school the first few days before giving birth or else they would start her maternity leave.

Basically from what I understand, even if you have your baby over the summer when there's no school, THAT's when your maternity leave starts, not when the actual school year starts.

For me personally (work for a non-profit), I've been told that I get 1 week fpaid or every year that I'm there (which will be 6) and get 6 weeks for reg. birth and 12 weeks for a c section. I'm not sure what that means. Does that mean I get 6 or 12 weeks on top the time i've earned?
Regardless, I must use sick and/or vacation time for the first week before FMLA or disability kicks in. It's really not an option of weather I take it or not. If i'm out of work for 3 days straight due to illness I automatically go on disability (i learned this first hand 2 years ago). I'm also able to combine any vaction, sick, personal, comp time to extend my time. If I'm calculating correctly and able to save everything then I'll get 12 weeks paid.

no you cannot collect unemployment, but you should be able to collect NYS disability pay (which is about $170 per week).

I just found out I am pregnant and am due at the end of August. I understand I will have to use my personal/sick days for the first 6 weeks and plan to apply for the FMLA for additional time.

I'm wondering if there is anyone who DOESN'T take this additional time? If so, how did you manage? And if not, I'm so confused as to why only 6 weeks are allowed.

I'm not sure how my husband and I can really afford for me to take this much time off from work, but I feel like 6 weeks is absurdly fast to return to work and leave a newborn in the hands of someone else.

I plan on attending the UFT workshop but I still am unclear on my health benefits and payments.

I've worked in the NYCDOE for 7 years - at the same school - and I find it so hard to believe that a) I have to use my personal days and b) I'm only allowed to use 6 weeks.

It seems crazy! You'd never guess that this rule exists in an institution designed to help children.

Any thoughts are much appreciated!




My son was born in August and just incase you didn't know- your 6 weeks begins from birth, not 6 weeks when school starts so it feels even shorter! So sad



you are only paid for the time you are not fit for work, "not medically cleared" only if you have the sick time. the FMLA only ensures that you will be able to keep your job and ins. It is not necessarily for you to be with your baby, however it is nice that it works out that way. That is why it is usually 6 or 8 weeks paid. If you were not to be medically cleared for some reason you can stay out longer and get paid if you have the days. I was out for a very long time with PPD and then a complication of a back issue.

I was put on BR in mid August and my time (12 weeks total) didnt start ticking until the first day of school even though I had not had my twins yet. When my 12 weeks were up I was still not medically cleared, for my twins were only a few weeks old.

as a teacher you get to use your sick time if you have it stored up. as a teacher if you go past your 12 weeks, not paid using the FMLA to hold your position ins etc. you can take the time, however you are not guaranteed the same position and you need to pay for your ins

I'm due 7/16 and going to take a few weeks of FMLA until Chat Icon is 12 weeks. I believe that you do NOT have to use up all your sick days if you take FMLA. You just won't get paid, but then at least you'll have your days.

FMLA is 12 weeks unpaid. I did not take it with my job as there was no need to, i was allowed to take as much time off for maternity leave as i needed. however, I have no paid maternity leave, and I am not eligible for state disability. so whatever time i choose to take off is unpaid, or my own accrued vacation and sick time.

FMLA was made so you can have up to 12 weeks of time off for medical reasons and not have to worry about your job.

No. 12 weeks of FMLA (which allows you to keep your insurance) and the 6 weeks of sick leave run at the same time, starting from the baby's birthdate. You are only docked sick days if you're missing a day that school is in session. Weekends, vacations, and holidays will not be docked from your CAR but do count towards your leave of absence. Once the 6 weeks are up (or 8 weeks if you have a c-section), you lose the ability to use sick days. So if you take off longer than the 6/8 weeks, you stop getting paid. You keep your insurance for the remainder of the 12 weeks.

eta: This is only for the NYC DOE. LI districts all have different rules re: FMLA and getting paid. I highly recommend going to the workshop, but they won't let you attend until the 3rd tri.

As far as I understand it FMLA counts only school days (breaks and summer don't count) mat. leave of 6 or 8 weeks uses sick days beginning day baby is born.
But don't feel guilty not taking the extra unpaid time off, many girls I work with do not. If you can't do without the pay check you have to go back. I envy the ones that can take the 2 years off, but I know I never will be able to, so I will do what I have to do to help provide for my famliy and so should you, WITHOUT any guilt!

You can't take unemployment if you are still employed. I recently attended the UFT NYC DOE Maternity seminar and I was thoroughly disgusted with the ridiculousness of the rules we have. 6 weeks out of your own bank or 8 weeks out of your own bank depending on the type of birth, even if you have more sick time, you can't take it. I've barely taken any days off in five years saving up and I can't even take 8 weeks if I want to unless I have a c section. I am due in March and am not happy about the whole situation.
