Even if it's their tree, it's your house, it's your expense and your homeowners policy...
ETA - I would speak to them about removing the tree. I have had friends who have done this with neighbors and they split the cost in doing so to avoid further damage.

We (LIF) went through this during the hurricane.
You have no rights as of right now. It's your problem, you have to clean it up. Your neighbor does not owe you a penny.
What you CAN do is get a certified letter to them telling them you are putting the, on price for the tree. If they don't do anything to the tree once you have put them on notice THEN they would be financially responsible.
Google this for specifics (how to send the letter etc). Or yes, ask your homeowners insurance how to do this.

Be very clear. You HAVE to put the, on legal notice (again, google how to put the, on notice) in writing.
Speaking to them does NOT preserve your rights. Only written notice does.

Yep.
Our tree fell on the neighbors house.. crushed the fence and their gutter. We gave them money to be nice and help them avoid homeowner's claim.. but then they tried to get more out of us AND refused to allow the tree cutting truck to use their driveway to access the problem tree! Jerks.

unfortunately as others mentioned, you have to go through your homeowners insurance
we just closed on a house 2 weeks ago and the first thing we had done (literally we closed thursday and Monday the tree removal company was there) removing 4 overgrown trees from the property. Both our neighbors came and thanked us - saying how they have asked for years for the previous homeowners to cut down the trees and they refused...any damage (one had fence damage) they had to incur the expense its extremely unfair def take photos though and speak to your agent

Neighbor's tree branch on my house, help needed!
This happened to us during Sandy, except it was my tree that fell on them. It destroyed a section of their fence and the gutter on the side of their garage. We offered to pay for the repair or any deductible since it would be on their homeowners insurance - they wouldn't take any money from us, but we were certainly willing to pay. Go knock on their door and speak to them.

This. I went through this last year and never once spoke with my neighbor whose tree hit our property.

We were told by insurance that if your neighbors tree falls in your yard or on your house it is your responsibility even though it is not your tree.

I always thought that branches that hang over onto your property are your responsibility and you have the right to cut them yourself? I know my parents have "woods" behind their back fence, the property belongs to an old woman who lives on the block behind theirs...they have to have her branches trimmed every few years bc if they didn't the branches would completely hang over their fence and house...they never even consult her, they just have the guys come trim the branches back to the fence line.
