Spinoff to my work question

So here is my other problem
I have a health condition and was thinking of filling for disability. My disease doesn’t necessarily qualify but it’s really bad and I know it doesn’t hurt to try. I have been missing a ton of work on and off for the past 3 years and while I know they can’t get rid of me for being sick they want to get rid of me since I am not flexible with my hours.

If I file and am on unemployment does anyone know how this works?

Am I killing my chances of getting disability while on unemployment? Should I file and continue to work and not take the unemployment?! Hopefully someone here can help me please I am so confused

You can’t get disability and unemployment. To get unemployment you must be able ready and willing to work.

Right, that much I know but what happens if I file for disability (which I am in the process of doing) and get let go? Can I be on unemployment until the disability is approved?

Disability takes a long time to get approved. You'll likely be denied at least once, especially if the reasoning is questionable. IME you''ll probably exhaust unemployment long before you're approved for disability. So, even though you can't collect both at once, you can collect UE while trying to get disability.

ETA: You should contact a disability attorney because they can really help.

Spinoff to my work question

SSI disability takes forever but NYS STD does not take long at all. Depend what you are trying to do but either way you can’t do both. If unemployment finds out that you are even trying to get disability they can cut you off because you are not ready and able to work.

If work is letting me go (really because of health reasons but they are coming up with something else since they know it’s illegal) can I take the unemployment? I just spoke to my doctor and he said he supports my need for disability and will help me with whatever I need from him...does anyone have a disability lawyer or someone I can talk to? TIA so much
So my question is can I take the unemployment? Disability takes forever and I do need some kind of income..

A disability lawyer can best answer that question.
It takes a long time to be approved for disability, especially if you are on the younger side. My husband was without income for 7 months, we were very lucky that he was approved on the first go around.

Does your employer offer supplemental STD/LTD coverage? It’s easier to get approved for STD but be prepared LTD is a long process and drains the savings.

No. He was not let go from his company. He was on short term disability until that ran out, then there was no income until SSI kicked in.
He decided not to go back to work because of his health issues. He was also 53 when he filed.

You can collect unemployment if you are ready, willing, and able to work. Unemployment also requires that you're actively searching for a new job.
