Are all teachers entitled to FMLA?

I never hear this used in my district - everyone just goes out on leave. So my question is, when I go out on maternity leave, will I be entitled to FMLA? (I am tenured and have been working for more than the required # of hours in the district).

I am concerned about the continuation of health insurance when I am out. I am due at the end of January and would like to be able to take the rest of the school year off, but I carry the health insurance.

From my understanding FMLA only guarantees you your job back after 12 weeks, and those weeks can be unpaid.

I assume that this also means the district does not need to continue your health insurance or other benefits, but I'm not sure. You should check with your benefits people/HR office.

I'm pretty sure FMLA ensures the continuation of benefits - that's half the "benefit" of FMLA (the other half ensuring you have a job Chat Icon).

Call your HR person, they should know all the specifics for your particular district (the union usually knows this stuff as well).

i work in NJ, but i know in my district it seems like most of the teachers who have had kids take the FMLA... its unpaid but i beleive the health insurance and everything continues during that time, as well as they hold your job for you.
in our contract, too if you're tenured, you can also take a full school year off ( unpaid) after the baby, and they hold your job for you. i'm a speech therapist and i share a room with the guidane counselor who is due in october. shes planning to take off all of next year....

All schools are covered under FMLA. As long as you've been working there for at least 1 year and have worked at least 1250 hours in the past year, you're protected by FMLA. This means that you're entitled to 12 weeks of unpaid leave. Your employer is required to maintain your health coverage throughout the 12 weeks. You will be required to continue paying your share of the insurance premiums. If you don't return to work after the 12 weeks, your employer may be entitled to recover the full cost of the health insurance premiums paid during the 12 weeks.

Unless your contract says otherwise, after 12 weeks of FMLA leave, your job is no longer protected and you are no longer entitled to health insurance (except through COBRA).

I thought all jobs had to abide by this. I know at my dad's company he was entitled to it when my mom was sick
