Anyone have custody of their step children and move out of state?
DH got custody of his 2 boys back in february and we're considering a move out of state. anyone do this or have experience with it? we have to look into if we are even allowed (they were never married so all those details were never addressed) and what the process would be first but i thought i'd check to see if anyone had advice.

from what i can recall it varies by state. before we were granted custody of my ss, we inquired what, if anything, we could do if she wanted to move - the lawyer told us - nothing could stop her from moving...there was a restriction originally to prevent custodial parents from moving outside of a certain radius, but they found that victims of domestic violence were kept under the control of that order, so they had to revise it.
i believe you have to notify the court and the non custodial. call your lawyer and see if there are any motions/notices which need to be filed. be forewarned, though that some states can require that he split the visitation costs with the bm, if the move consists of increased transportaion costs

I have primary physical and residential custody of my two daughters. We were living in Maryland and I decided that I wanted to move my daughters to New York to be near my parents/family and our entire support system.
The courts will need to determine if it is the best interest of the children for them to move away from the non residential parent, whom they probably have regular visitation with. Depending on how far you move that visitation can change drastically and a new visitation schedule will need to be decided. Because I wanted to move and yes, it was in the best interest of my children to move, I am responsible for the transportation for them to visit their father. Once a month, I put my daughters on a plane, alone, for them to see their father.
We've been living in NY for two years and it is still not easy. Good luck

I think every situation is different. My DH has it so she can not move off of long island with my ss.

but what if you can no longer afford to live here? i know they can then switch parental custody of the children i guess if they think its not in the best interest but i highly doubt their mom would get custody back, not at this point at least. ugh i know in order to do this we would have to spend $$ on a lawyer.
