-UPDATED- I am FREAKING OUT -JOB related
I just found out I dont qualify for FMLA Mainly because I was out last march of surgery on short term disability and that was hours "not worked" and I went part time in Sept. I dont have enough worked hours to qualify.
Im gonna lose my job, I know it.
Today was the 13th day I have been out sick since Sept for the throwing up. There is no way they are gonna keep me.
What am I gonna do? How Am I gonna find another job pregnant and throwing up?
01/11/07
Well I went to work today although I havent eaten yet today. Apparently I still have a job and my ONLY option is NY state disability.
Now, do I do that? Do I do it now and then again when I deliver? I dont know.
the Dr's office is not helping. I called 3 times in hysterics today that I havent held anything but fluids down in now 3 days and the one Dr covering for mine says "see an GI Dr"...Well the GI dr's I called said this is PG related, they wont see me. He then told me thats his only advise( ???????)....so I called AGAIN crying that SOMEONE HAS TO HELP ME ....
The NP explained to me..one that I gained a lb....ONE POUND but apparently that means Im nourished. And that one can live indefinatly on fluids alone. And she is satisfied if I keep down one egg, or one bowl of broth a DAY....Even for 20 more weeks and that the baby will be fine. And I have to just deal somehow with the lethargy that occurs from not eating.
Its like Im losing my mind here. There has to be a better way?
And Im not sure what to do about the disability.
Ok..nto much of an update in the end.
HAD to vent. Thanks for listening , you guys are great!

They can't fire you for being PG. They could make a case for excessive absence but still it is a thin line when dealing with someone PG.
I just throw up at my desk. Not ideal but an option.
You need to talk to your OB again and see if there is anything else you can take.

Re: I am FREAKING OUT -JOB related
I would def call your DR and see if there is anything else they can prescribe you...They legally can not fire you for being pregnant, but being absent is where they can get you.

Oh I am so sorry. You'd think that a healthcare company would be more understanding.
They cannot fire you for being PG, that is for sure, and since you are doing everything medically necessary to try to get to work, I am not sure they can hold your absences against you either.
The FLMA part stinks though, I am not sure what you can do about that.

I totally agree. I actually have an extra trash can to puke in.
If someone says something to you about it now, just say that you didn't realize that you did not qualify for FMLA.
Did you try Phenegren yet? Maybe that will work better for you then the Zofran.

I was going to say the same thing regarding them firing you.
Before I was PG, I worked with a girl who did the same thing; she would just run to the bathroom every time she didn't feel well. That way, they can't say you are not there.
Good luck!

Re: I am FREAKING OUT -JOB related
The problem is it is likely too late for all that. We are allowed 5 sick days in a 12 month period.
I have used them all up and then some.

what about unempolyment until after the baby is born and then try and find something else? Or maybe you can go out on disability now before they can fire you.

can your coworkers donate sick or vacation time for you? I know some companies allow that when someone is really sick and uses up all their time.

Re: I am FREAKING OUT -JOB related
Donna I am so sorry -- I have no idea -- can you maybe get a job that allows you to work from home? There are answering services and customer service type things -- would that work? I don't know what you can do although it is risky for them to fire a pregnant woman. Perhaps they will at least wait until you take your maternity leave...?

Re: I am FREAKING OUT -JOB related
Are you sure you don't qualify for disability? Even if you don't qualify for FMLA, you can still qualify for disability benefits. If you have severe morning sickness, your doctor should be able to certify that you're unable to work. According to the NYS Division of Human Rights website, you can receive up to 26 weeks of disability benefits. I'd look into that. NYS Division of Human Rights
Also, although your employer may fire you for excessive absences, the company cannot treat you differently than other employees. For example, if other employees are excessively absent, but keep their jobs, your employer cannot fire you. Good luck.
