This guy is NOT going to be let off. He is going to fry. The lil girl's grandmother is a politician and she will see to it (with whatever connections she has to use; may it be right or wrong) that this guy never sees the light of day.

This guy is NOT going to be let off. He is going to fry. The lil girl's grandmother is a politician and she will see to it (with whatever connections she has to use; may it be right or wrong) that this guy never sees the light of day.
Good!! This defense lawyer makes me ill!! I realize he has a job to do, but wouldn't your conscience bother you just a little bit to know that you are helping to free someone who is GUILTY as sin!!!

I totally agree! All the jury has to hear/see is pictures of the scene of the accident or even worse, if the mother testifies, hears her speak about what happened that night and having her decapitated daughter laying on her lap.

I totally agree! All the jury has to hear/see is pictures of the scene of the accident or even worse, if the mother testifies, hears her speak about what happened that night and having her decapitated daughter laying on her lap.

A criminal defense lawyer has to put his personal feelings aside when defending his client. I can't imagine defending murderers, rapists, etc, but if you do, I think you have to remain detached from the situation. I don't think the defense lawyer should be blamed for doing his job. If he doesn't have a good argument, the judge won't grant the motion. I hope the police followed the proper procedure and that the guy gets the maximum sentence.

All I know - is if the kid took the test to me that is confirming that he was asked. They are not going to just do a test by shoving it in a guys face, right?

They can do it without permission if the suspect is unconscious. The defense is saying he was conscious enough to have said no. And they are saying he was never asked.
If this gets thrown out... you can blame the cops for this one.

Very true. I have grown up with members of this family (like the bride who's wedding it was) and it is a well-known family and this jackazz will not get off. Grandma is a politician, grandfather is retired police officer, uncle is police sargeant. I hope he rots in he ll!!

If I was a juror, I'd only have to see the pictures of this horrible accident and hear family testimony to reach a decision.

I understand that. But the defense is saying the cops never ASKED him. I know he could have said no... and maybe he would have said no if the cops would have asked.
I am just saying that if it is true... that the cops didn't follow protocol and never specifically asked him "can we draw your blood"... instead of just doing it... this is a major f'up by the cops and will greatly change the outcome of this case.

A good defense attorney will destroy that claiming "you will never know FOR SURE" without the positive test.
I just hope the cops followed protocol in this case.

What about a breathilizer? I didn't think you could be required to take one, but I'm not sure. Can you be required to take the other drunk tests (i.e. walking on a straight line, touching your finger to your nose)?

I like the law in FL...if you refuse then you are admiting guilt.
