NO WAY!!! How in God's name can anyone become a Defense Lawyer for people you KNOW are 100% guilty...
Under that theory, people who are guilty shouldn't get any defense... do you really want to go there?If they get no defense, do they also get no trial? It sounds like the middle ages, or a place like Iraq to me.
Their are plenty of cases that attorneys pass on because they know the guy is guilty- that's why there is Legal Aid. In this country, every defendant is entitled to a defense.
If you have faith in the system, then you believe that the truth will prevail.
For once I have to agree with Pill. If the cops didn't ask him, then they did violate his rights. You can blame the cops or the judges and/or legislature who set up these standards.

I just looked it up. Chemical test refusal is an automatic $300 fine and six month licence revoke. You also have to pay a $750 fee if you want to get your licence back after the 6 months is up if you already had a DWI in the past five years.
There is no possibility of jail time with a refusal.
If you take the test and fail... its the same 6 months revoke... the fine is 500-1000... and you can also face up to a year in prison.

I agree. You have to put your personal feelings aside if you're a criminal defense lawyer. Everyone has a right to a fair trial, and procedures must be followed. A lot of people get off on technicalities, but we need to have a system with uniform rules/procedures. If the cops did not follow the procedure, they should be blamed, not a lawyer who's doing his job.

I like the law in FL...if you refuse then you are admiting guilt.
What do you mean admiting to guilt? Guilt to what? The FL law works no different than the NY law. The only difference is in FL... the minimum suspension is 1yr... but if its your 1st offense... you can apply for a "hardship license" which will shorten the penalty.
There is no jail time for refusing a test... so there really is no "guilt" to admit. You get no jailtime.
You just get your license suspended.

I am sure there are a lot of defense lawyers out there that truly believe that there are a lot of "innocent felons" in our jails.
I am sure that not every single person who got put in jail was actually "guilty".

I am sure that not every single person who got put in jail was actually "guilty".
actually project justice has proven that by using modern technology (DNA) to exonerate death row inmates or lifers.

I also agree.
I saw Alan Dershowitz (sp?) speak once (he is a famous defense attorney). He is Jewish and he said as much as he wouldn't want to, he would defend a Nazi because he believes so strongly that one of the most important laws that makes the US a great country is that every one has the right to an attorney and that procedures must be followed. Though every now and then, a technicality gets someone off or an innocent goes to jail or justice is not served, OVERALL, we have a fair judicial system.
