a legal/debt question***updated at bottom***
my coworker called me flipping out last night, a creditor put an $8,000 "hold" on her bank account. We got paid yesterday & she said her whole paycheck was taken, plus the money she had in there & now she is overdrawn. She called her bank & they gave her a lawyers phone # & said they couldn't tell her anything else. She's had a lot of financial problems & divorce & stuff but she doesn't think she owes anyone that much. She said she never got anything in the mail saying this would happen or even any bills that would match up to this amount. She's going to call the law office first thing this morning. She's freaking out & I tried to find info for her online about how this works & I'm not finding much. It takes her almost 3 months to earn $8,000 so what happens? They just hang out waiting for more money to get deposited? I told her to tell my boss to stop her direct deposit but we don't get paid again for two weeks anyway. I know if she owes the money its her own fault but I still feel really bad for her, she said her car insurance is due & now she has no money at all for two weeks. Any lawyers or anyone else with info or advice I can give her?
Thanks for all of advice & suggestions, she made a deal with the lawyers office, she really only owes $4000 so she had to fax a statement from her bank account to them & they made a deal for her to pay the rest off monthly. Her bank account will be off lockdown next week sometime. In the meantime I lent her money to pay her car insurance. I'm glad she was able to make a deal with them.

Some where a long the way someone has filed a judgement againest her and has finally acted upon it...She would of been notified of the judgement but if this was years ago perhaps she forgot b/c it took them so long to act on it.

thanks, I just read something similar on credit boards. I have a feeling its going to be something from when she was married, maybe she'll be able to get her ex to help pay it.

The bank will have to place a freeze on her account for DOUBLE the amount of the judgement. I believe it's called a restraining order.
Once the debt is resolved, the attorney can send a release to the bank.
I see this happen every day.

It depends upon what the divorce papers say...

update, she's on the phone with the lawyers office now, its an old collection agency debt from when she was married. It seems like they're going to let her make payments. Thanks to everyone that responded

She was very lucky!!!! Glad to hear it worked out...probably was coming up on SOL.
