Any home buyers experts out there?????
We just got a call from our lawyer saying that he got a copyt of the seller's deed and the deed isn't in his name! It's in his girlfriends (or x-gf) name!!!!!!!!!! We have signed the contracts but they haven't been sent back to their lawyer bc our lawyer was waiting for a copy of the deed. How how does this affect us?

IF the deed is not in his name, then he can't legally sell the house - he doesn't own it. He has to get the ex to sign all the papers.

yep- prepare yourself for a bumpy ride- I have seen my DH have to deal with this on the mortgage side- and if they get along- it will be ok- if they don't- she is going to do everything in her power to make it hard for him to sell

It's not his house. He has no rights to sell it. The gf/exgf is entitled to the proceeds.
The other thing is there could be a missing deed that has not been recorded yet. They may have intended to put title into both their names at a later date if he didn't qualify for the mortgage.
