Anyone in Medical billing/insurance??
If you could help me out I'd super appreciate it!! DH went to the hospital last year, had a bad cut, it was supposed to go under workers comp, but the company has since sort of disappeared and we are trying to locate them. Anyway, our insurance is in my name. We are getting bills from a collection agency now, because his old company never paid the debt to the hospital and they are coming after ME. I don't understand this. I received NO treatment, the insurance is the only thing in my name and they never even tried to bill insurance. Is this legal?? I am not my husbands mother..he is a big boy can take care of his own bills...why is this in my name. My credit is being ruined because of this and its not fair...I never was a patient there. Is this legal. The guy in collections told me it would not be changed it is what it is. But how is this fair, its my husbands problem to fight, not mine and now its all in my name, why would his old company pay it anyway when its all in my name. This is ridiculous..$1000 for a friggin bandaid!!! Is there anything I can do to get this switched into his name??

I am confused.
the hospital bill is in your husband/s name as the patient.
who submitted the bill to worker's comp? who provided your husband's workers comp. ins. info to the hospital?
how did they get your name or insurance info?

They took down our insurance info, even though it was an injury through work. Then DH called in the info to them for his company. His company never paid it, after we submitted all the bills to them and they said they would take care of it and they have sort of disappeared now, but we think we have located them (old Job). But the bill is in MY name with him listed as the patient and they are telling me at the collection place that this is how it is.

the company your husband worked for doesn't pay the bill.
the INS co. pays the bill.
the hospital should have sumitted the bills to the INS co.
IF it's denied, then you can go through whatever private insurance you have.
call the COMP carrier. then call your ins.
also, call the collection agency and explain the hospital did not exhaust it's insurance options before coming after you.
and this cannot ruin your credit unless they take you to court and win a judgement against you.

it can still ruin her credit - if its a collection account now it is on her credit report - but good news is once you settle the collection it will be off and your credit will be back to normal.

not everything in collections automatically goes on a credit report.
especially dr's offices. as far as I know (and I did this for years) dr's office bills are entered on a credit report after a judgment is sought and won in the court.

They are coming after you because you are the primary member... ie, the holder of insurance.
You might have some luck at the New York State Workers Comp Board online. There are a bunch of online claim forms and they might even be able to help you figure out what type of Workers Comp Insurance your DH's company had at the time of his incident.

I am unsure whether your regular health insurance will pay this though if it was entered as an injury at work on the original claim... They might, but I am not sure.
Have you given the collections agency your regular health insurance info?
Here are some because I work in this industry and I know how hard it is to straighten all of this stuff out!
