Anyone know how Short Term Disability works for pregnancy?
I am a teacher in the NYC Schools but I am not returning in the fall. (I am due Sept. 25th) I know I can file for FMLA benefits prior to the baby being born BUT someone mentioned that you're entitled to Short Term Disability benefits in pregnancy. Anyone know how that works in NYS and how it coincides with the FMLA? Not sure where to look for info. Thanks!!!

Short term disability is 6 weeks for a vaginal birth and 8 weeks for a C-Section, it runs concurrently with FMLA, so you can take an additional 4-6 weeks after disability is up at no pay.
Right now the rate for diability is 1/2 your salary, up to a max. of $160/week.
I believe you have to take a week of sick time before you can file for disability, but am not 100% positive on this.

you have to sign up before you pg and there is I think a 6 month holding pd that you have to wait because they would not cover you if you are already pg I tried to sign up but I didnt know this fact it was too late
i ended up doing better on fmla but I already used all of that I had 10 weeks vacation that I used saved up and then I used fmla 1/2 pay and now b/c I have been at my job for 9 yrs I am entitled to 36 weeks at 1/2 pay under sick leave so I have been getting paid the entire time I am out plus I will still get paycheck after the baby but I can't take anymore time than what I am allotted 6w for vag or 8w csect if it wasn't for being out this long I could have had atleast 12 weeks off without penalty and I would have gotten all of that at full pay by then I would have had another 2 weeks vacation and 1 week personal not to mention all my holidays I get time instead of time and a half pay...

That isn't for NYS disability - it's for disability insurance through a private carrier such as AFLAC

I'm a teacher too and I plan on soley just using my short term disability , since I only have a few personal/sick days that I can use when I go out.
I signed up for it in September...and it didn't go into effect until this January...they even joked around to "not get busy until December." If we planned on getting pregnant. You can't get it if your already pregnant...my co-worker tried.
But I will be on half pay for up to 3 months and an additional 3 at quarter pay if I need it.

I was using AFLAC as an example, CSEA is your union, so that is a seperate benefit specific to your job. NYS Disability insurance benefits all working citizens of the state, not just publuic sector employees. I do not believe that it covers self-employed individuals though.

My job is giving me the forms for my Dr to fill out and then send them in.
It is 6 weeks for regular 8 weeks for c-section but you do have a 1 week holding period so really it is 5 weeks or 7 weeks.
Why would have to sign up before your pregnant?? I didn't do that when I was pregnant w/Hayley and I got my disability.

ugh, I just got that big packet of forms mailed to me from HR this week
just when I finished a huge pile of medical claim forms, hospital admin forms, and other junk. Paperwork wise, I feel like I have to file a tax return every week lately
I should read up on the details of this right now too, now that you mention it.......

If I have more than six weeks worth of days in my bank I can't use my day? They only let you use 6 weeks paid?? Even though I have the day I would have to go under FMLA? FMLA is not paid correct??

FMLA is 12 weeks of unpaid leave. As far as using your sick time, it depends on your employer. Under FMLA, your employer must allow the substitution of accrued sick leave where leave is taken for a serious health condition, but does not have to allow substitution of sick leave where leave is taken for other reasons. Barring complications, women are considered disabled for 6 weeks for a vaginal delivery and 8 weeks for a c-section (that period is leave taken for a serious health condition). Any leave beyond that time is taken to care for a child, not for a serious health condition. Depending on your employer's policy, you may not be able to substitute sick leave for those additional 4-6 weeks of leave.

You have to sign up before you are pregnant when you purchase private disability on your own through AFLAC or another private disablity insurance provider. If your job provides disability, then you do not have to sign up as your employer did so when you started to work for them. Not all employers provide this insurance, so some people purchase it on their own.

The best person for you to ask this question id your HR department. Everyone's situation is different depending on who their employer is..... everyone on this board is going to give you a different answer based on their own experience.
