Anyone knowledgeable about Social Security Disability Benefits?

A very close family member of mine is going thru a horrible divorce. Long story short....

His STBX receives permanent disability which I have a hard time understanding how she pulled it off as her condition can be fixed with surgery. She also receives money for their son who is the non disabled dependent. She has been putting that money away for years saying its for college.

Now that they are going thru this divorce she has been "crying broke" although has racked up over $10,000 on her amex (she has a shopping problem) and of course my family member is responsible to pay half of the bill when hes barely getting by. She wont touch the money put aside for the son from disability to help pay for everyday things like food, clothes etc. She either charges it or expects my family member to pay. Mind u, hes already paying her rent and bills still.

My dad looked up the disability laws and he saw something like the money for the nondisabled dependent should be used to help the child during the years leading up and until he finishes high school. Which I interpret as his current living expenses which she is charging on her amex as well as her $500 jeans etc. that my family member is left paying half her when hes already paying her rent, bills, car loan, etc.

Just to explain it for better understanding, she recieves $1000 a month for her son which she never touches. She has saved something like $30,000 so far which she wont touch.

He should consult a lawyer. Well worth the money IMHO.

He already has a divorce attorney...do u mean a disability lawyer?

I would hope that his divorce attorney would be able to get to the bottom of this.

I don't know about that law & sorry your family is having problems. I can say that just as child support is paid & fathers get upset. The money the woman gets/spends is her choice to do what she wants. Just as nobody can tell a person how to spend child support.. Your family member should consult a lawyer, but then again they can't force her to spend that money

This is definitely a good point.

I also wonder if since this is your family member, it's clouding your perspective.

I've said this before on here, but people think they know the whole situation when it comes to someone being on disability, or any other form of assistance.

They also think it's just "so easy" to go out and get a job.

To that I have said, would YOU want to work with this person? Very often the answer is no, because that person has issues that are going to influence the working environment/co-workers.

I still feel that he needs to consult his attorney and find out from them about things such as closing credit cards at this point, and how much he needs to contribute to child support.

Also, someone said something on the relationship board the other day that stayed with me.......it's easy to not care what happens to the ex, but if their child is going to be staying there for a significant portion of time, it is probably a wise idea to care about their living situation.


ETA: How many of us who are NOT going through a divorce, but may have fallen on difficult financial times, have savings set aside that we don't want to touch in case of an absolute emergency? I am sure A LOT! Just some food for thought..........

Unfortuately for your family, I think this is correct. As long as it is claimed as part of her income when they (meaning attorneys and or Court) are reviewing their financial information. It may be something that will be further explored down the line, but, even so, if she is truly putting this money aside for the benefit of their son, I don't know what, if anything, would really be done. I can't imagine a Judge forcing her to stop putting money away for their son's future. Your family member should make sure that his attorney is aware of the situation and let him or her take it from there.
