When I rented in an apt complex I got a check for the interest I earned on my security deposit every year. Our management company kept a separate account for each unit's security deposit - it was like $3/year. I'm doubting that the landlord of an illegal apt is keeping your security deposit in an interest bearing account.

Landlords are supposed to put the security deposit in escrow. I'm not sure if they're required to, but most put the money in an interest bearing account. If it's an illegal apartment, I wouldn't be surprised if the landlord did not put the money in escrow.

yes- my sercurity deposit earns interest- it's never anything exciting- and I get a tax form on it
the max it ever was - maybe $5

Mine earned interest as well, like 1% (pretty much the same rate as a normal savings account).

Our security deposit earned interest as well at the Heatherwood Complex. When we moved they cut us a check for the interest and we used it to pay for the moving van we had rented to move.
