How could she not know, or how could she not have done research to understand that when putting in TWO EMBRYOS that there is a chance that BOTH WILL STICK. Are you a moron? And how can you give one up? How would you even choose? I really, really, really hope that this is some sort of post pardum freakyness and that her husband is hen-pecked because I can't imagine that people like this exist in the world.

I can appreciate the stress and anxiety that may come with the reality of twins, -

OMG that is terrible. I am in shock. You would think someone who went through IVF would be over the moon with twins not "devestated!!" I can't believe this woman. This makes me so mad.

Lawsuit lesbian mums rebuke critics September 20, 2007

TWO lesbians suing a fertility doctor after one of them became pregnant with twins today hit back at claims they should not have had access to IVF or given up both girls for adoption.

In the first case of its kind in Australia the women are suing prominent Canberra obstetrician Dr Sydney Robert Armellin for more than $400,000 in the ACT's Supreme Court for implanting two embryos instead of the requested one.

The amount sought would cover the cost of raising one of the twins, including $158,000 for a private Steiner school education in Melbourne.

The case has sparked widespread condemnation of the women in the media.

Liberal senator for Tasmania Guy Barnett has urged a ban on publicly funded IVF for lesbians and single women.

"Every child that comes into the world should reasonably expect the care and affection of a mother and a father," he said.

"We seem more intent on preserving and pandering to the wishes of adults, than we are in protecting the rights of children."

The mothers, whose names are suppressed, said the case had nothing to do with their feelings towards their daughters but Dr Armellin's failure to comply with their wishes.

"This has never been a case about whether our children are loved," they said in a handwritten statement.

"They are cherished."

The couple said the reaction exposed the belief in parts of society, including the gay and lesbian community, that minority groups should be grateful for equal rights.

"If gratitude is a condition of these rights, then they are not full and genuinely equal," the women wrote.

Dr Armellin's barrister Kim Burke said the birth mother only told her client she wanted one embryo minutes before she was sedated on November 12, 2003, after previously signing a form consenting for up to two to be implanted.

She said if damages were awarded the amount should be reduced by 35 per cent due to the women's failure to reasonably inform staff at the Canberra Fertility Clinic of their wishes.

It was reasonable for Dr Armellin, who was a consultant at the clinic, to assume a staff member would have clarified the number of embryos to be implanted with the women and relayed that information to the embryologist before the procedure, Ms Burke said.

"The system failed because of the plaintiff's failure to tell anyone about the number of embryos to be transferred and because the staff did not follow up," she said.

"There is no evidence to demonstrate he (Dr Armellin) was responsible for the system."

The mothers' barrister Hugh Marshall SC said the ultimate liability for the mistake rested with Dr Armellin, describing him as the "ringmaster" in charge of the procedure.

He said Dr Armellin's responsibility to ensure his patient's wishes were carried out was magnified because of the fact she was sedated during the operation.

"She is entirely at the mercy of the doctor, she is entirely in his hands," Mr Marshall said.

The risk of multiple births when two embryos are implanted into the uterus is 20 per cent, which drops dramatically to 0.1 per cent when only one embryo is used, the court was told.

"Point one per cent – that is the risk to which she consented," Mr Marshall said.

"The risk she did not consent to was the 20 per cent increase that two embryos implanted would bring.

Justice Annabelle Bennett will make her decision after the lawyers send her written submissions next month.

So, she was sedated and suddenly changed her mind and the doctor was supposed to comply? And what if it did not take? Then she would have been up in arms that she had to do it againg?
This woman has some serious issues.....

So the twins are 4 years old and they are NOW bringing a lawsuit???

She signed a consent form for 2 embryos to be implanted so that was the plan all along and changed her mind MINUTES before being sedated... what is the doctor supposed to do, not go by what is in writing???

I want to see what the judge has to say about this!

Um what a dumb ******...hello if you do IVF you have a high risk of multiples dumass. That couple doesn't deserve one child nonetheless two. I hope they take both children away from her. And if she was so adamant against having twins why didn't she reduce one? Sick I know but my OB told me he had a couple who did IVF got preggo with twins and then reduced to one.

You know what though there are alot of dumb people in this world who don't deserve what they have.
