attorney question for anyone who sold a house
Did you see the contract before the attorney sent it off to the buyer's agent? Our attorney wrote it up and sent it out the minute my agent called to say a price was agreed upon and gave them the buyer's attorney's name. I figured we had a day or two to write up our exclusions.
I am furious because the buyers signed the contract and sent in their deposit with a clause saying that they want my really expensive office furniture. When my agent questioned it, their agent said because the top shelves are attached to the wall they felt it's part of the house. We had to bolt them to the wall because they were top heavy - they are not built-ins. We were planning on filling in the holes and repainting the entire wall. Did you ever hear of this before? I can't risk losing the deal and that furniture is worth over 10K. It covers a huge area and includes an entertainment center as well. My husband is so calm about this stuff and I've been awake and fuming since 4 AM!!! Thanks for your thoughts and for letting me vent.

Your attorney would simply say that the office furniture isn't allowed.
He will either call the other attorney to let them know, or send them back the contract with revisions on it.
I wouldn't worry about the technical details behind it. I would worry though that if the buyers really want that office furniture, they may hold out for it.
