Sorry, I disagree with you on this.
It's well worth the 2% transfer tax to keep our wooded and undeveloped land.
Brookhaven is the most western area of Long Island that still has large amounts of undeveliped land and I, personally, think it's worth the money to keep it that way.

The tax is not applicable on first-time home purchases and the first $250,000 is exempt, so it's not going to have the terrible affect that some think it's going to have.

This tax is not added to your yearly tax, it is only applicable on homes being sold and IMO is going to an excellent use...so I say vote Yes!!!!

I just wanted to add that I think there is nothing better than the fact that I can walk my dog from my house to the woods and see deer, turkey and other wild animals...and I would do whatever I could to preserve that.

I have to agree! I think it's a good thing as well. My parents still live out there and I would hate to see the area become even more developed with strip malls and track housingChat Icon

imo there are far better ways to finance these purchases (bonds, use current tax revenue)

I like to keep open spaces too- but with the astronomical cost of closing costs, if you are buying a $450,000 house, that is an additional $4,000 the buyer has to pay.

and if they buyer doesnt pay...the seller is responsible?

also, "Brookhaven voters already approved a $100 million dollar bond issue for open space acquisition two years ago. "

we are already paying for it!

eta: in 2003 the town tried to do this and the courts found that the wording included misinformation and would not let them put it on the ballot.

if they want to stop development, stop giving out permits, they don't need more taxes to do so.

If the buyer doesn't pay, the buyer doesn't get the house. If I didn't pay all my closing costs at closing, my lender wouldn't have given me a mortgage and the seller wouldn't have signed over the property.

what ive been reading is that if the buyer doesnt pay (lets face it, mistakes are made at closings all the time), there is also recourse to the seller if it doesnt get paid.

My take on people saying the seller could be liable is that IF buyers say "we don't want to pay it, so we're not buying the house" THEN the seller may choose to have to pay it.

I didn't get the impression from anything I've heard that legal recourse would be taken against the seller if there was a mistake at closing. Whoever is legally obligated to pay the tax (per the contract) is the one obligated. Then again, I'm just going by my impressions of what I've read, so I'm NOT an expert.

Buyers may find these homes less attractive b/c of the tax - but I don't see how sellers will find themselves obligated to pay it UNLESS they want to b/c they feel they won't otherwise be able to sell the house.

I totally agree that it's a big disadvantage to sellers and homeowners in the area. (I don't live there, but have been reading about this)

I don't get this proposal. Are they giving us an ultimatum to outbid the developers?
Like- "well, fine- Brookhaven- we won't sell your parks to condo developers if you give us the money they would.". Because our regularly outrageous taxes should be covering the basic maintenance of these parks, no?
This is extra money to sort of buy the land ourselves. They're taking bids.

Is this $$$ REALLY going to preserve land??. Because everywhere I go out east, it still looks like they are building.
My friends just bought a house and they had to pay $8,000...that is CRAZY!!!

I'm a HUGE supporter of land preservation, however town of brookhaven already has the highest number of acres of undeveloped land that is a "forever preserve" & that is the majority of the pine barrens. My house is in the pine barrens & my neighborhood is surrounded by land that is owned by NYS-brookhaven state park and on the other side is a smaller area owned by brookhaven which includes Corey Pond. Brookhaven acquired this parcel a few years ago & they have let it get destroyed, local kids have created acres of BMX tracks that look like something out of the movie "holes", its littered with trash & stuff people dump there. Its a friggin disgrace.
The other area owned by NYS is beautiful & immaculate-we hike 3 to 5 miles every weekend & I rarely see a shred of trash. The DEC & the forestry dept police this area & it is a beautiful respresentation of what our preserved land should be.
I'm not interested in brookhaven creating more dumping sites on my dime right now. Especially while the real estate market is soft....not a good way to generate the funds at this time.
richard Amper the president of the pine barrens society & possibly the most well known enviromental preservationist on LI lives a few houses away from me. He has been all over the news with this, we agree on most things but I disagree with him on this.
I voted no.

I voted yes also..... it's not an annual or re-occuring tax, so I was fine with it. My rationale is since more and more people want to move here to enjoy the open spaces and nature, the existing residents need to put a premium on it, and protect what they have....
