Can you contest a moving violation taken by a camera?
I just received a ticket in the mail for a trip to the zoo we took last month. DH was driving.
It was taken by a camera from behind.
The problem is that DH NEVER goes through red lights. I don't make it up!
How the heck do they have us going through the intersection, never stopping at the light is red.
I swear it's photoshopped!!!!
How can we contest this? This is insane!

i have heard of cases down here in the DC area where people have contested it b/c they say you can't prove that it was you driving the car. not sure if it'd work, but might...

I agree. I highly doubt it's photoshopped, these things are computer generated and I doubt they have someone sitting around photoshopping pictures.

You could try but I don't think so - There are signs all over that section before the zoo saying red light cameras. I think they are set to go when the light changes - so maybe you thought you went on a yellow but it was red. I know they turn pretty quick there.

I work for a insurance company in NJ and those tickets usually can not be contested, unless youir vehicle was stolen or the car in the pic is not yours.
They are no points bc there is no proof who was the driver of your vehicle.

Unless you were making a legal left across an intersection, I think you're stuck.
The cameras are only supposed to take the picture if the car enters the intersection after it's already turned red. So if you're in the intersection already when it's yellow, you shouldn't get a ticket. I used to think all your wheels had to leave the intersection before it went red, but I was wrong.

i got one of those going to the zoo too. the light turns yellow to red so fast you don't even have time to brake to stop for the yellow. there's almost no warning. i was literally up at the intersection when it went yellow, and i still got the ticket which i think is a load of crap. if they don't give you enough time to go through on a yellow because you can't stop in time, its nonsense, but we paid it anyway. wasn't going to fight the picture, but i sure would love to see the computer program that snaps them to make sure they are taking it after that light is truly red. (i think they timed that light specifically to get people)

If the light was yellow & turned to red too quickly, it sounds to me like you have a case - particularly if you were making a left.
I imagine you can send the not quilty plea in indicating that you believe the traffic light is broken. Only problem is you may have to go to court in the Bronx for it (assuming it's where the ticket was issued) .

Unofrtuntely it happens in life. I know it stinks, but its highly doubtful it was photoshopped and even still, if you try to contest it they will probably hit you with more fees than the original ticket.
If it were me, I'd suck it up and pay it and be done.

Your tax dollars at work, the local government is paying people to photoshop you running a red light and then you have to pay for your own ticket. That means local governement is making people pay from both ends.

No, no car. There are 2 pics. the first one looks we are not even stepping on the brake light. Then second pic is us going right through the intersection on a red light.
Honestly if it was just DH by himself, I would have thought he ran the red light but since I was with him in the car I KNOW he did not go through the red light when we were entering the intersection.
The light MUST have gone from green to red instantly has we passed the white line. From what people are telling me (I am asking all my friends!) this is a spot well known to get people. Apparently I am not the only victim of this stuff.
DH was so mad last night he sent a letter to the zoo that we would reduce our visits there.
I am convinced this is a scam for the zoo visitors.
ETA: I will pay the ticket. What can I do, right? It's scam from the City against me.

Which intersection was it? I used to go to the NY Botanical Gardens a lot that's right next door to the zoo. It's not Fordham Road and Southern Boulevard, is it? I caught myself in that intersection making a left on red a lot of times.

No, it was the Cross Bronx /Rosedale Ave intersection.

Honestly, and I am not poking fun, but if that is your only defense is "he never goes through red lights," there is no way the court will dismiss the ticket. Remember that lights in the city turn yellow significantly faster than they do on LI. Next, perhaps you were distracted at that very moment (i.e. looking in purse, turning to check on DC, etc.)? I'd save myself a trip to the Bronx and pay the ticket, since it will not result in any points, etc.

Yes, I am not going to Court. I will pay the $50. We don't go through red lights. DS was in the car with us. We are very careful when driving with him.

Well, I don't know if this is the same thing but my husband's friend got a ticket from one of the cameras while we were in the precesisonal of cars to the cemetary to my brother's funeral. He went through the red light to continue with everyone. It was at the light when you get off the LIE for College point BLvd. 22B.
I think he fought it and he hasn't paid or heard from them again.
