Cell Phone Ticket

Things just keep getting worse... a few days ago I posted about my car being hit and the guy not responding after he found out how much the damage was.

Today, I was stopped by an officer because he saw me with "a cell phone to my left ear" even though I didn't have one. I asked him to check my call logs but he asked for my license and registration. My last incoming and outgoing calls were from yesterday. I'm going to plead not guilty and bring in my cell phone records and my DH's (who was in the car with me). BUT, can't the judge just say that it could have been someone else's phone or that the records don't belong to the phone I had with me?

Has anyone else had experience with something like this? Is there a better argument for stating I wasn't even on the phone? I am in disbelief right now that I got a ticket for something I wasn't even doing.

ITA... and from my experience with tickets like this, lots of times the officer that wrote the ticket doesnt show up... in which case you have a better chance of winning...

I would also print out your husbands cell bill as well. That way you can prove you were not on HIS phone either.

I had the same thing happen to me about 2 years ago--unfortunately the cop showed up, the judge wouldn't let me speak, and I had to pay the ticket.

In a cop's word against yours, unfortunately, they cop always wins.

However, now that there are points associated with it, maybe they plead these tickets down. You might get a no points conviction but be prepared to still pay a hefty fine. If you do get points, you can now take defensive driving online to reduce up to 4 points.

This scenario happened to a friend. She was driving in Queens and she got pulled over by a very rude cop. She had no idea what the issue was and when she asked he said she was on the phone, when she was NOT! She was livid too! I know she went to court last week but I haven't spoken to her to hear the outcome.

Oh boy - that's terrible Chat Icon Why would he even think that?! Were you leaning against the window/door or something & he assumed that having your hand on your head meant you had a phone? That's crazy - if you decide to fight it, good luck! Chat Icon Chat Icon

See, this is what I'm afraid of. That's basically what it is: my word and cell phone logs against his. I also found out that effective 2/16, it's 2 points for cell phone tickets. I know I'm not guilty but in this case I just have this feeling that I'm screwed.

I was trying to go through all those scenarios in my head. Like, was I brushing hair away from my face? Was it my coat that covers half of my ear? But, I'm sure that I wasn't doing either of those. I'm convinced that he followed the wrong car. He said he saw me on 84th and 3rd Ave and he gave me the ticket on 85th and Park Ave.
