cell phone tickets...advice
I got a ticket today for holding my phone while it was on speaker phone. Is it worth fighting? Has anyone fought it and had it reduced? I think it is points now, right?
I got it in Brooklyn this afternoon if that matters...I am so bummed I didn't have it on my lap!

Even if it was in your lap, you'd get a ticket.
The only way you could have avoided it was with an earpiece.

I got a cell phone ticket in Queens before they gave points for it (but still the hefty fine). I plead "not guilty" on the ticket, but in front of the judge, I just agreed with the report the police officer read. The judge dismissed the cell phone ticket, but I still had to pay $80.

I want to fight it just I don't get points but I am afraid of that too! I am such a scardy cat!

i got one the week the 2 pt law came in.. i had my phone clipped on the sun visor and it was on speaker. my sister and i hung up but i took the phone down from the sun visor to the cup holder bc if i stopped short i didn't want it falling and hitting me (happened beforeLOL) - at that same exact moment the cop pulled me over and gave me a ticket..
i know she saw me take the phone down from the sun visor and saw i wasn't on the phone when i did that.
i paid the fine - it wasn't worth me going into brooklyn and try to get it dismissed. my insurance wasn't affected by it.
sorry that happened.

You can try fighting it, go to court (if you can afford to lose the day), and hope the cop doesn't show up. Chances are, he/she will, and it will end up costing you anyway. The law states that the mobile device only has to be "in proximity" of your ear and that will then create the legal presumption you were engaged in a conversation (even if the cop doesn't see you actually speaking). This has to take place however, while the car is in motion.....so yap away all you want at a red light, lol. I think it's just best and the most safe to have a hands free device......texting and talking on the phone while driving has caused many accidents and injuries from distractions that I could live without....horrible sights to see when kids (or anyone for that matter) gets hurt because of this. Just seems so avoidable to me.

I also got a cell phone ticket the week the 2pt law went into effect last year I went to traffic court and right away they not it down to seatbelt ticket and then no points you pay the fine and go home I did the same thing with a ticket I got in September....it was not fully stopping at stop sign (points also) went in they dropped it down no points

I agree. Yesterday we were driving home from Queens and some woman was doing the same thing and came half was into our lane. Invest in a bluetooth headset or earbuds.

I thought "hands-free" meant hands-free? You can't use a speakerphone, but it's OK to use your hands and your eyes to fumble for an earpiece? I always thought that as long as you weren't holding the phone, it was OK.

It's funny b/c I travel soo much for work and where I go it's all legal. So if you drive across farm in Nebraska its so lonely I just chat. The only thing I will kill is a cow or me. So far in my territories Texas, Louisiana, Nebraska, Kansas, Tn., Ok, Wisc. you see everyone just yammering away it's nuts. I mean they are allowed to carry concealed weapons, so why not talk on the phone at the same time??

Well, here is my update...I have been trying to put my plea in online but it still says that the ticket is not there...weird. I am hoping to shows up soon. I am pleading not guilty just to avoid the points. I have my blue tooth all charged up but I will admit that thing never stays on my ear for whatever reason!
Does anyone know about how long it takes to get a court date once you enter a plea?

That's why I got a bluetooth speaker instead of a headset. It just stays up on the visor all the time.
