Child Support Question

I'm hoping someone may have some insight on this. My DH pays a large amount of child support monthly for his daughter. We often go without certain things we need or may want and have gotten used to it. But now we have a baby on the way and since I've been put on bedrest we're really struggling financially. Has anyone had experience with having a child support order decreased? His daughters mother makes about $30k/year more than he does but I dont think thats taken into account.

I don't have experience in getting support decreased personally however I know it is not impossible to do if you can prove that the mothers earnings have increased signifigantly since the last order of support was ordered...From what I know, your DH's subsequent children will probably not sway the order, but the BM's financial status should be taken into consideration, if not for support than for anything above and beyond that he provides for the child ( schooling, extra curriculars etc...) The pro-rata may be adjusted ...What I believe he needs to do is file a motion to modify the CS agreement ( something he can do on his own without an attorney) Chat Icon

child support is based upon the parental income. if the mothers income increases then her share of the child expenses increase...

For one child the courts find that 17% of the combined parental income should go to the care of the child.

so if the Mom makes 100K and the dad makes 50K the combined income is 150K and 17% of 150K or 25.5K should go to caring for the child.

To determine who pays what of teh 25.5K it is prorata based upon your percentage of the income. in the example here the mom makes 67% of the income compared to the dads 33% so the mom would be responsible for 16,830 and the father would be responsible for 9,435. Of course that would be prorataed monthly.
