question about Child Support
Currently I am receiving child support for my 9yo DD based on papers we had drawn up in 2001. Since then I have gotten married (was never married to DD's dad) I have moved (2x) and DD's dad has moved as well.
I want to get the papers amended with my married name, as well as the $$$ amended as well. My question is....does my DH's income count when they calculate how much DD's dad gives me?
I found THIS SITE which has a brief overview of how they calculate the $$. It says "Combine both parents’ adjusted gross income." but it also says "as should have been or should be reported in the most recent federal income tax return" but my tax return has my DH's income too. Do they seperate it?
If they calculate it using DH's income as well, then my DD's dad is going to be paying more then 17% of his income. I always thought it was 17% of his adjusted gross income, I didn't realize they took mine into consideration.
Also, right now it says DD's dad is also responsible for 50% of child care expenses and 50% of unpaid medical expenses. Does anyone know or have 50% of extra curricular activities included also? My g/f has this for her DS but I have never heard of it other then that. Ex-BF and I have always worked that out on our own, but now that DD wants to do more then one dance class it's becoming a problem
Help please!! TIA !!!

Re: question about Child Support
They do not use your current dh's salary - basically - this has nothing to do with him.
Have you looked at their on-line website?
Its newyorkchildsupport.com
its pretty helpful - i had to do a name change as well -and i think you can request a review also. at the very least it can give a phone number to call.
I had gotten a percentage for child care - when my son was younger (not anymore) - it wasn't 50% - because for that they take your salary into consideration as well. I made more, so I had to pay more than him. Any extra activities you will probably have to foot the bill - he is obligated to pay for that.
