yes and no....
The only two things i've heard about was in FL (for the everglades) and in CT (for a highway)
FL - yes...it was for nature and to help the area. CT - no because im sure there were other alternatives.
This gives the state too much right to say, we need this for somthing, so your out. kinda scary if you think about it
imgaine if they did that on LI with 135 being extended oing to CT like they should of?

The original theory behind eminent domain is to be able to use private space or homes in a time of war.
I think that in emergency situations, it may be necessary.
But I don't think that what was done in Connecticut was right at all! That was done to benefit a private corporation. The Court's argument was that the taxes derived by the corporation would benefit the state. I think that benefit is too remote.
I believe that if there is a direct benefit to the state, and there is an emergency and/or no other alternative, then eminent domain is proper.

hard to say, in most cases no...If I own property it should be mine, without a threat, But I can see in some situations where it would be better for all.
Any examples?

I don't argree with eminent domain, especially as it is written. It is way too open to interpretation.
"Public use" can be a highway, a subway, a park, a school (which are ok, IMO) OR a stadium. Eminent domain is being used to evict homeowners for a proposed stadium in Brooklyn. That, i do not agree with.
Plus, I am not very clear on how the evictees are compensated. Are they getting fair market value for their property? Or are they getting what the government says it is worth?

they get more...their is something "added to it"...Mu aunt and uncle had this happen to them. They got 300K for their house in 1985, it was probably worth about $100-$120 tops at the time. It was bought by the state to be used as was the entire block for extension os a sump(dump).

I agree with it in certain cases. We wouldn't have highways on Long Island in some cases if the government did not use eminent domain to obtain the land to build on.
I do not agree with the current trend of buying up people's homes for "economic development" - where they tear down the houses to build new shopping areas, office space or housing developments. I think this is simply another way rich developers get richer and the regular taxpayer gets screwed.
