Family Medical Leave VS Maternity Leave ???HELP!!!

This is definately premature but I have a question. What is the difference between a Family Medical Leave and Maternity Leave? Are they now the same? If FMLA exists in your company, does that mean that there is no maternity leave. The FMLA says you ned to be employed for 12 months or more. Does anyone know what happens if you get pregnant and you are there less than 1 yr? I was very curious!!

with FMLA, you have to be there 12 months when you have the baby, not when you get PG.

not all companies have it - there have to be a certain # of employees in the company

this is the nyc fmla website, it's pretty much the same as ny state fmla.

>>Yes. Basic City health coverage and several Fund benefits (Basic Life and Accidental Death & Dismemberment Insurance, Superimposed Major Medical, Dental, and Vision Care), paid for by the City and the Fund respectively, will continue for up to a maximum of 12 weeks for approved Fund members.

basically, they don't have to pay you, but they do have to pay for your health insurance for 12 weeks max. that's what i was told by my HR department.

now what about maternity leave...does that still exist? I am afraid that if I get pregnant, well have a baby before my year ...what happens?

I also know that with the FMLA they HAVE to by law hold your job for 12 wks.

Not sure if they only pay for up to 6wks. It sticks that its only half your pay, which is nothing and I mean nothing on my pay. One MOD told me,"why should we pay for you to have a baby." I mean at least treat your employees good when they have been at the job for a long time. I mean don't you want them to contiinue working their.

I believe if you are at your company for less than a year when you have the baby that you are not necessarily covered under FMLA, meaning they might not have to hold your job for you. I also know my company made a coworker pay her health insurance benefits for the weeks she was out b/c she did not qualify for FMLA.

Maternity leave is company specific meaning some companies will pay part or all of you salary while you are out after having a baby. My company paid nothing so all I got is 8 weeks new york state disability (which is only $160/week max).

You would have to talk to your HR dept and see what your company does or doesn't offer as far as maternity leave.

exactly - in my job, maternity leave is actually called child care leave, and is TOTALLY separate from FMLA

basically my company's policy is that they will hold your job for up to one year and all your leave is unpaid unless you take vacation/sick/personal time you have accrued.

FMLA states that they have to hold your job for 12 weeks if you have been working there for one year. i think they have to pay your health insurance too, i'm not sure... it's all very confusing and i would talk to your HR department about it.

unless it's in your company's policy, PAID CHILD CARE LEAVE IS NOT GUARANTEED.

FMLA leave is 12 weeks of unpaid leave. Employers are covered under the Act if they employ 50 or more people within a 75 mile radius. If your employer is subject to FMLA, you are eligible if you have worked at least 12 months and 1250 hours in those 12 months. Your eligibility is calculated from the time you take the leave. Under FMLA, your job is protected for the 12 weeks that you are out. If your employer paid for your health insurance, your employer must continue paying for the benefits during your leave (you are responsible for paying any portion that you had been responsible for prior to your leave). If you do not return to work, your employer is entitled to seek reimbursement for the amount spent on your health benefits during the leave.

Each employer can decide whether to offer more generous benefits than those provided under FMLA (i.e. paid leave, longer period of leave, etc). Check your employer's handbook and/or talk to HR.

I agree with everything here.

You may want to ask your HR now what your office does.

Trust me it's worth knowing.

If I knew I'd get preggers my first try I'd have waited a few months to pick up the additional Short Term benefits I can purchase from my company.

Its easier to plan when you have time to save up or think of alternatives.

My company offers Short Term disability (paid by company) for 70% of my salary for 6-8wks depending on type of delivery. They require I use my sick days but do not require my vacation days which are optional. They also offer "bonding time" or maternity leave for 4 weeks at full pay AFTER the 6-8wk time period.

I totally wasn't expecting that 'bonding time' and I'm grateful for it.

So my advise... ASK NOW
