Family sues over fatal car chase crash

Accusing police of "cowboy" tactics in a high-speed chase that ended with the death of a father of two in his living room, William Calhoun's family filed notice Thursday that they plan to sue Suffolk and Nassau counties for $20 million.

"It's still mind-blowing to me," Brian Calhoun, 25, said of the Dec. 28 crash that killed his father in the Farmingdale home they shared. "He was so healthy. We really expected him to get to be a grandfather."

Calhoun, who was home at the time of the accident but was not injured, said police should have let the fleeing suspect go rather than risk lives in a dangerous pursuit.

"We're not arguing that shouldn't get the guy, but there are other ways," he said. "This didn't have to happen."

Suffolk police, who initiated the four-minute chase, referred questions to the county attorney's office. County attorney Christine Malafi declined to discuss the pending lawsuit.

"Our sympathies go out to the family ... but we've not had the opportunity to investigate as we were just served on this," Malafi said last night.

In a statement issued after the accident, Police Commissioner Richard Dormer said the pursuit was justified and that officers followed department guidelines.

The notice of claim filed on behalf of the Calhoun family charges police with "failing to terminate the chase after it became obvious that the perpetrator would flee, the risk too great and the reason for chasing not justified."

The document, the precursor to a lawsuit, also says police violated their own pursuit policy when they chased suspect Richard Mair, 28, of Ridge, at speeds witnesses said appeared to reach 90 mph.

"No sane person can take the position that this chase should have gone on for more than 30 seconds," said Mineola attorney Bob Sullivan, who represents the Calhouns.

Calhoun, 59, died when Mair lost control of his car while fleeing police and crashed through Calhoun's garage and living room on Fulton Road, crushing the homeowner on his couch.

Police said Mair fought with police before being arrested in the destroyed room. He was arraigned on felony fleeing from police and driving while intoxicated. Officials have said that Mair, who was on parole for a drug conviction, could face additional charges. Mair remains in jail on bail of $2 million.

Both Suffolk and Nassau police declined to discuss their pursuit policies, citing concerns that the information could be used to elude police.

Sitting in her North Babylon apartment, Linda Calhoun, 58, said the death of her estranged husband has most affected their youngest son Christopher, 19, who is severely autistic.

Christopher spent weekends with his father, often going to movies and playing video games with him. Calhoun said the pair spoke by phone daily.

"He doesn't grieve like you or me, but he's lost a part of himself," she said.

Like Brian, Linda Calhoun questioned the police officers' choice to pursue Mair, who took off after officers approached his car and asked for identification. Police have said an officer smelled alcohol on Mair's breath.

Sullivan said that while Mair was chased by Suffolk police largely within that county, he also filed the notice in Nassau while the facts of the case are still being learned.

"As regrettable as this incident was, there is no possible liability here for Nassau County," said Nassau County attorney Lorna Goodman.

I'm sorry but he was running from the police.. It was his own fault.

ETA - sorry I misread.. I thought the driver was killed... it was an innocent bystander.... def. a different story, but I still don't think they have the right to sue.

There are very specific rules about chasing in residential areas. There are speed restrictions for pursiut, as well as neighborhood restrictions. Sorry but the police did not follow safe protocol here.Chat Icon

I have many cops in my family & their job is incredibly hard. I know it is even harder for them to have a possible drug dealer in pursuit & let them go, but at the risk of civilians in the area, the rules are there for a reason.

I think this is ridiculous. Police are damned if they do and damned if they don't just for doing their job. It was a sad and very unfortunate accident. I'm sure the police didn't want it to end up that way but they were just doing their jobs. No need to sue and I hate when people nickel and dime something like this.

I agree. I think that it would be very bad for everyone if the Police became afraid to do their jobs. However when rules are broken & people get hurt, it is not good for the community at large.
I think it is a very tough balance, I really do.

No, it was a horrible accident.. Was there anyway at all the police officers could have predicted something like that would happen?
Again its like the case with the boy who was killed by LIRR - its not even a month after this happened and they are already suing, I don't get it... why is everyone so sue-happy?

Agreed.

It is tragic what happened but the person in the car was drunk- I don't believe in just "letting him go" so he can use his car as a weapon to kill someone else.

I think in the majority of instances like this- the Police need to pursue the person b/c they are under the influence and the odds of them continuing on and killing someone else in another car or a pedestrian are a lot greater than what actually happened in this specific case. So, it's unfortunate this time but I agree w/ the Police on this one.

--and to sue? It just seems like the people who are suing, and I mean no disrespect here, but it seems like the people who are suing for monetary benefit- need to keep their eye on the ball, if you know what I mean.

It's human nature to want to "blame" someone when an accident happens and unfortunately suing is the way some families feel is an appropriate way of dealing with it.. It's sad that it happened but suing is not an answer.

In many states the police are not allowed to chase anyone unless they are wanted felons. There are too many stories of innocent people getting hurt in these chases....Chat Icon

That's what I though at first that the drivers family was suing.. I thought that was absolutely ridiculous

does anyone actually know the rules about car chases? I feel IF the cops were breaking their rules then the family is entitled to sue... isn't that the point of lawsuits...I'm all against frivoulous lawsuits, but if the rules were broken and someone lost their life I don't see why the family isn't entitled to compensation

as tragic as this is they are only suing the counties b/c they have the $$ to pay or at least to settle.

they would never get that kind of $$ out of the guy who drove the car.

Wait I missed something, the kid that died while tagging the train tunnel?

OK that is too far. The kid was doing something illegal and NOT being chased into the tunnel by the cops...correct?

Yeah thats the kid - and just to clarify, I am not saying these cases are comparable in any way except that the families are suing within days of it happening.

This line makes me mad. They didn't initiate the chase. The guy fleeing from the police initiated it! If he hadn't fled, there would have been no chase!

I see it as this: If he hadn't been killed, he had money to be made before retiring and then pensions and whatever after retiring. It was of no fault to his own that he died in this accident. His family is owed some sort of compensation. $20 million may seem excessive, but they probably won't get all of that anyway. I don't have a problem with this one.

Police Department has deeper pockets. The state of this country is so sad. Everyone sues for everything. It disgusts me. This was an unfortunate accident that was not the police's fault, if anything they should sue the driver of the car. This is why we need Tort Reformation in this country. The sueing has gotton out of control.
