does anyone actually know the rules about car chases? I feel IF the cops were breaking their rules then the family is entitled to sue... isn't that the point of lawsuits...I'm all against frivoulous lawsuits, but if the rules were broken and someone lost their life I don't see why the family isn't entitled to compensation



I agree with this- I can't see how they are allowed to chase in residenance neighborhoods

what if a child was playing outside and got hit?

Just wanted to comment on one thing that was previously posted, this family (and the family of the kid killed by LIRR) have "filed suit" so soon because if you are going to sue the City or Nassau County you are required to file a notice of claim within a specificed amount of time. If you don't file that notice of claim, you are precluded from suing. This is most likely why this has happened so quickly.

Police Department has deeper pockets. The state of this country is so sad. Everyone sues for everything. It disgusts me. This was an unfortunate accident that was not the police's fault, if anything they should sue the driver of the car. This is why we need Tort Reformation in this country. The sueing has gotton out of control.

what if a child was playing outside and got hit?

I asked a friend who is SCPD, they are not supposed to pursue a chase in a residential zone if the person being pursued is driving over 55 MPH. Supposedly they are supposed to call ahead & try to block paths, but I am not sure how effective this would be either. Chat Icon

Again its like the case with the boy who was killed by LIRR - its not even a month after this happened and they are already suing, I don't get it... why is everyone so sue-happy?

OK that is too far. The kid was doing something illegal and NOT being chased into the tunnel by the cops...correct?



Yeah thats the kid - and just to clarify, I am not saying these cases are comparable in any way except that the families are suing within days of it happening.

I did not even hear that the family was suing.

That is just absurd.

They have absolutely every right to sue. Put yourself in this families shoes for a minute and think...would you honestly say, oh it was an accident lets move on? I don't think its quite so simple for these boys, who one minute had a father, who was sitting on his couch in his own home watching TV and the next minute, dead, crushed by a car that came though his livingroom, which was the result of an extremely fast and dangerous pursuit that should not have even happened in a residential neighborhood. I am sure the family is suing the guy who crashed as well, but their suit against the PD is just hotter news. The idiot drug dealer is of course first to blame, but at one point the cops should have backed off, they still would have gotten the guy, whether it were an hour later...I have no doubt. But these boys are now without a father, they are angry, sad, hurt and pretty destroyed by all this and looking to point blame....which in my belief is on the police just as much as the jack@ss drug dealer that started it all!!

Was the criminal going over 55?? I'm not sure- I don't think I recall seeing what speed they suspected him to be traveling at.

I witnessed a criminal/Police chase once... A guy had stolen a Police car and they were chasing him- They blocked off parts, etc and they ended up having to shoot him b/c he got out of the car, pointed a gun at the officers and would not drop it after they repeatedly asked him to. Many cars were hit, many people injured during this chase... All innocent bystanders of course but what can you do? This criminal needed to be stopped. It was scary!Chat Icon

ETA: the mother of the criminal who was shot (BTW, the newspaper referred to him as a victimChat Icon) tried to sue the County and then the Officers personally.

I was just looking back into one of the articles and witnesses that saw the pursuit said it seemed they were doing at least 90 mph!!

I def agree that they are well within their right to sue. you don't have a high speed chase through residential neighborhoods! in LA and other areas, the cops back off when those who they're chasing go into neighborhoods.

Didn't this happen on Route 109? Not exactly "residential". It probably started in a more busy section and then moved to residential. Can't exactly ask the perp to slow down now, you're in a neighborhood.

I live a block away basically from where this happened.....literally a two minute walk and I don't think I would consider this a residential area. There are about 3 houses and then commerical buildings....it's a Main Road where this accident happened. I was one of the people there when the accident happened and had talked to people that saw most of the chase. This car came off of the Southern State and traveled down Rt 109 which is not a residential area. It was a horrible accident....never saw any thing like it...but quite honestly I wouldn't think it was the fault of the police who were doing their job and trying to stop this guy from doing all of the illegal things he was in jail for prior. If any thing, they should be suing the guy who caused the accident in the first place, which I'm sure is going to occur. I feel horribly for these people and I think this was really tragic. I just think to sue the police is a little silly.
