i think that as long as he is not playing during the early morning or late at night that it is fine to keep the drums in your apt.

tough call - we live in a complex as well, so I see both sides.
I don't think you're doing anything wrong since you limit the time to normal hours.
But as others have said, he may not be the only one it annoys. Plus, does he sleep during the day? That's another thing to consider. If he's a DJ, he may sleep during the day.
Also, are your other neighbors home during the day, or are there more retired people?
I do agree though that he shouldn't be complaining if he is playing music at 10 at night.
But, this could easily turn into a "tit for tat" type deal - and in that case, if it gets brought to management's attention, you could end up in trouble - especially if he complains first and gets a few people in the building to back him.
I would talk to him first and come to some sort of compromise. Let him know your sleep schedule so he can be mindful of the music, and find out his schedule of sleep, so you can be mindful of that.

They are the same age as us- and like us- they are at work during the day (he Djs on the weekends every now and then)

Let him play - if the neighbor wants to play nasty be sure to complain everytime you here his radio or tv or dj'ing after 9
