FMLA and Maternity Leave Question

I apologize if this has been asked 1000 times before.

If a company allows 6 or 8 weeks of leave, depending on the type of delivery, is that included in the 12 weeks allowed for FMLA or is it separate? Meaning, can I theoretically take 6 weeks maternity leave and then 12 weeks FMLA leave?

It's up to your employer, but those 6 or 8 weeks of leave are almost always included as part of the 12 weeks of FMLA leave to which you're entitled.

what she said. With FMLA you are entitled 12 weeks FMLA annually for you or to take care of a sick relative. It protects your job and allows you to only pay the employee contribution of health care benefits while you are out. If you were to take a LWOP, you would be responsible to pay the employer portion of the benefits as well.

Thanks ladies! I'm fortunate that I'll be able to pretty much design my own maternity leave but I want to be fair and stay within the guidelines, so to speak.

Remember that if you take time off BEFORE you have the baby (bed rest, etc...) you employer can consider this as part of your FMLA time. So you would have to deduct it after the baby is born.

So let's say you go on bed rest for 2 weeks and do NOT come back to work and you give birth. You have a c-section.

So that 2 weeks before birth, 8 weeks for c-section and ONLY 2 weeks in addition.

So you would have to go back to work after 10 weeks PP.

Of course, your employer can always negociate with you but legally you would no longer be covered with FMLA.
