FMLA question
Does anybody know if this can be taken in ADDITION to the 6 or 8 weeks disability? In other words, can I go out on disability and when that is done, then take the 12 weeks unpaid Family Medical Leave? I've been thinking lately that MY disability due to pregnancy is not the same as me taking the 12 weeks allowed to care for a family member -- newborn.
Also, if my doctor were to put me out of work early, it would be deducted from the 6-8 weeks allowed by disability, but then I would still be eligible for the 12 weeks FMLA. Right?
Does anybody have the answers to these questions? I want to have my own information before I speak to my HR dept.

Sorry to bust your bubble, but most companies will run your disability and FMLA concurrently meaning that you will stil only get 12 weeks (unless your doctor allows your disability to run past 12 weeks).
So if you for any medical reason cannot work up until the date you give birth your work will start counting that as FMLA. You will most likely be paid your vacation/sick accrual time on top of the disability payment. Then you will just be paid your disability payment for the 6-8 weeks.
If for some medical reason you can't come back in the 12 weeks of FMLA leave your doctor can prescribe you more disability, however i am not sure if your job will be protected.

Yep this is my company. I will get 6 wks short term disability through my company and hopefully, IF they give it to me, I will get another 6 weeks FMLA.
The FMLA says that your company CAN give you UP TO 12 weeks, it's at their discretion. They can give you 6 weeks or 1 week - it's entirely up to them.

my understanding is that FMLA kicks in as soon as disability kicks in. in NJ, we have a separate FMLA that kicks in after disability and overlaps with federal FMLA extending the time one can take off unpaid.
i am going to start the paperwork process this week, but this is what i have gathered to date. it's very confusing...

Also just an FYI...FMLA only protects your job. If you have a good relationship with your boss or company in general they can give you off as much time as they want to...unpaid of course. FMLA only protects your job for 12 weeks from companies that might want to get rid of you because they want somewhere there who can work.
I can't imagine having to go on bedrest say at 30 weeks and delivering at 38 weeks. That would only afford you 4 weeks to be home.

I was put on bed rest for 2 weeks and it came out of my 6 weeks disability and FMLA. meaning I got 12 weeks health insurance coverage and used 2 for bed rest. So after baby was born I only got 10 weeks health insurance, then had to pay cobra.
