Re: getting out of a cell phone contract
I tried getting out of my ATT contract multiple times even after there was fraud on my account done internally. They would not budge on the 200 dollar cancellation fee! Even after they continued to screw me over, they were extremely rude. It was the 200 or stay in the contract.
Who do you have as a carrier?

I had ATT and switched before my contract was up. They will absolutely will not waive the $175 cancellation fee no matter what.

I don't think you'll be able to get out of it w/o paying the fee.
I fought REALLY hard with Sprint and finally just paid the $175 to leave them. yes it sucked, but I am SO much happier with Verizon! so it was worth it.

Re: getting out of a cell phone contract
don't switch to Sprint! they have horrible coverage and even worse customer service!!
If Sprint was the last cell carrier on earth, I would not have a cell phone.

Re: getting out of a cell phone contract
I am in the process of cancelling my Verizon contract wayyyy before it ends. There are basically three ways to get out of your contract early.
1) Your in the military and you are being shipped overseas.
2) You die
3) You have no service where you live or work and you must complain even if you do have service and threaten to contact the BBB.
I am choosing number 3 not that #2 is an option.

Re: getting out of a cell phone contract
Port your number to Verizon or Sprint or whoever. This ends your service with ATT.
When ATT tries to collect their termination fee don't pay them.
When they attempt to sue you, countersue and cite THIS CASE
Granted you probably shouldn't do this. But hey you can mention it to ATT and threaten them with this case.

I don't think that is a very good suggestion at all. Only because the civil case was in California and not in New York, and really its still going on...its not 100% finished as the carriers aren't finished fighting in court. Plus the court case was started in 2006....even if people started organizing this now, it could take forever! If she ported her number now, during that time she didn't pay the termination fee, it would wind up being reported by ATT on her credit report and could affect her negatively. Messing up your credit isn't worth all that IMO.
I would possibly MENTION the case--but I could not go ahead and port the number and just NOT pay the termination fee...doesn't seem very logical to me.

I was being a little facetious with that post.
But just because the case was a civil case in California, that doesn't mean its any less citeable if you actually wanted to go to court over a termination fee.
Ok if you want some real advice, I would do a google search on how to get out of an ATT contract. Cellphone Carriers are constantly changing the terms of their contract. It's usually just minor things that would never really affect you, but when they change terms in your contract that can occasionally leave a window for you to "opt-out" of the change and end your contract without a termination fee.
