If there was no damage to your car or hers, chances are your car is fine. I was rear ended twice.. One time was on the parkway and the person who hit me wrecked their car. my bumper fell off and the whole trunk got pushed in. The other time I was stopping at a light and the person behind me neglected to step on their brakes. This time there was minor damages. Both times I called the police.
Being you were rear ended you are NO FAULT. You do not need to call your ins. company. The only problem I forsee if there is any is that you have no police report, no witnessess. From your description, you were just bumped from behind- thats what the bumpers are for. I am sure both you and your car are fine. But its scary, I know!!

I work for a car insurance company and handle claims.
You can still go to the precinct and make out a report if you want.
If you are not feeling well, you have to call your insurance company to file a claim so they will pay your medical bills if you decide that you want to see a DR. You only have a small amount of time to file a no fault claim, so don't wait if you think you want to do this.
You can settle it between you and her but I have seen MANY times that the other person gives you the run around and does not want to pay for 100% of the damage even though estimates were written on the damage.
You can file with her insurance for damages and if you don't know who that is, your insurance company can tell you by them running her plate.

i read your original post but not all of the responses. first off, thank god you're okay! secondly, as you may or may not know, i am a cop... i can say you honestly didn't do anything wrong in not calling the cops to file a report. IF you call the cops, an accident report gets filed - no if's, and's or but's about it - your insurance company will know about it and your insurance will go up, just because you were IN an accident (your fault or not). as far as still filing a report... the police cannot (or at least are sure as heck not supposed to) write up an accident report, once you have both left the scene of the accident. if you decide to file a report, you have up to a week to get a "civilian accident report" filled out and mailed up to albany. all this means is that you go to your local precinct, ask them for a civilian accident report - YOU fill it out yourself, the cops have nothing to do with it - and you mail it in. again, your insurance company will get notified. if you don't have any medical problems from the accident, and no damage to your car - then i wouldn't bother. i doubt the lady is going to bother to do anything... she probably knew she was at fault (when you rearend someone, there's really no way around that one) and either didn't want her insurance to go up, or was worried that she'd get in trouble by the cops for not having her ins card on her (it's required by law to carry it in nys) or doesn't have insurance on the car at all, in which case she'd really be screwing herself! lol so if you're worried about her, i don't think she's going to cause you a problem. at this point, the only reason i'd file a report is if you have an injury or if you have damage on the car. good luck!

I'm so glad you're ok! I always call the cops, though. Last year someone hit me and he was begging me not to call the cops. I was newly pregnant and scared, so even though the damage wasn't terrible, I called the cops anyway. Turns out that the car was STOLEN! YES STOLEN. And it got impounded on the spot. He didn't know the car was stolen, he had bought it from someone, but still, I'm glad I called.

I had the exact same thing happen to me over the winter. My mom and I were in the car and I got rear ended while I was at a stand still at a light. The driver that hit me was lucky that I didn't take my foot off the break or I would've smashed into the car in front of me. I was ready to leave after taking her name and number and insurance info but my mom insisted that I called the cops. The woman that hit me was an older woman and she didn't want to go to thru insurance. The benefit of the cop coming is just that they'll mark in the insurance report that in no way were you at fault. I was a little sore for a day or two after but I think that was from being so tense from the whole experience. As long as you have her information, I would think you should be ok. I would get an estimate done ASAP though, and call her on it- even if it is minor damage. My "minor' damage to the back of my SUV's bumper was almost $600 just to have the paint touched up. She mailed me a check. Hope you're ok!

I work for a car insurance company and after hearing the horror stories of people denying involvement when there's no police report, I always recommend it.

That's not true. We insure high risk taxis, limos etc and they get in a TON of accidents. We only know about the ones reported to us.
In a case where someone was hit in the rear there is 0% liability against the insured so why would their insurance go up? Your insurance does not go up if they never paid a cent out.

Yeah....I thought you get 48 hours to file a police report/call insurance company to file a claim. But I'm not positive.
