I am BEYOND furious *vent* apt - Long (any attorneys wanna help out?)

First off I live in a very very affluent neighborhood here in San Antonio.
Very difficult to find apts or homes here (our housing market is still good)
Great schools, fantastic stores, rolling in money area.

I pay $1100 for rent which is like $1900 in long island ok? 3bdrm with attached garage 1340 sq ft. A good deal but pricy here, still for what you’re getting its really a decent (not great) deal.

Here’s what’s happened:
Tub is shoddy work, the surface keeps peeling up and needs to be ‘resurfaced’
Kitchen counters surface chips off and needs to be ‘redone’
Both of above are highly toxic fumes and need a full day to set
They were late doing this and I got kicked out of my apt for a day (and my cats)
Numerous outrageous BS when I moved in (old appliances and crap in the cabinets, holes in the walls, missing door handles, missing refridge door handle, etc)

So my tub is peeling AGAIN
My counter tops are chipped AGAIN

In Sept we had our garage door apparently fall off the track and opened into the sprinkler system knocking the pipe loose and spraying antifreeze laced water all over my garage which still had boxes of clothes and items … soaking everything.

Today I call because
#1 Never heard anything about that claim and my damages are small (around $250) but my renters won’t pay as it has a $500 ded
#2 There’s no hot air coming into my daughters room so it was 60 in there last night
#3 The garage door ‘vent’ has been open for weeks it seems as a cat has been living in my garage (with the boxes) taking dumps and god knows what (I’ve smelt the poo)

They say they’ll schedule repairs for #2 & #3.

But get this.. they WONT pay for the water damages??!!?!?

Said that’s why my insurance is for. Never mind they were negligent and its their fault. They said that their deductible is $10,000 so they wont pay. Can you believe this??

I went apeshit on them and said they can NOT refuse my claim and if they try I’ll find an attorney and come after them for a lot more than $250. I am SOOOOOOO angry right now. I can NOT believe this place. I’m not required to keep insurance and even if I was, its for MY items and not should not affect THEIR liability one bit!

God I wish I could break the lease!

I dont want to agree with them because I think it is so wrong...but in my building we have the same thing. If a leak or something happens even if they are at fault we are expected to go through our own home owners or renters insurance. It is such BS. They forced everyone to get it after a basement flood destroyed many of the basement apartments and the building said it wasnt there problem, to go through insurance.

As far as the heat goes in your daughters room ,I think they just need to be bled (sp?) ,but everything else is ridiculous ....Oh Man I would be PO'ED !!!!

I would call them back and throw the word "Lawyer" into the mix and let them know you are not messing around !!

You have renters insurance, like you said "for your items" ! And b/c they were neglegent they should br paying ! WOW ....you should definately call someone to look into this !!

A co-op is totally different from renting.

To the OP, I wouldn't really think that an attorney here could help as they aren't probably admitted in Texas

Same with mine - they fix the walls & ceiling but they are not responsible for the things on the walls & ceilings like pictures, light fixtures, etc. If something like that gets damaged I am responsible for repairing or replacing it.

We arent required to keep renters insurance (its not part of our lease)

The damages were caused because they had cheap garage doors and very badly installed sprinkler systems. It is 100% the fault of the apt complex.

I understand deductibles but all that means is that the INSURANCE company won't pay. It does not relieve them of responsiblity.

The management says they dont know their insurance company .. they have to call regional office to find out more.

They have done everything in their power to avoid giving me that information. I think my local management is trying to tell me they informed me back in Sept nothing would be paid because its probably procedure, thing is.. she didn't. Even if she did, I repeat, they are liable. If they keep this up, I'll take them to small claims court. I think I have that right since my insurance company won't pay. Maybe then I can break this lease.

I am actually drafting a nastygram to send to my landlord.

Google "warranty of habitability". They are REQUIRED to correct these issues. If they don't, you can do the repairs yourself and withhold or deduct the repairs from the rent.

Not to many leases require renters insurance. It is something that renters should get called contents insurance--this protects all the contents of the apartment/house. If something happened and the home was destroyed all your contents would not be covered under the landlords insurance.

Ok I dont have the background on this so I have a few questions....how is the sprinkler system shoddy? Was there a problem with it before the garage door falling on it? Just because the garage door fell on it and the pipe broke doesnt make it shoddy. From the info you have given so far I have to say I think the damage to your belongs are you responsibility.

the system is incorrectly intalled (according to the fire dept). Let see if I can describe it.

Imagine an L shape at the bottom right tip is a 6inch pipe hanging down with a sprinkler head which is protected with a wire cage type enclosure. The garage door rolls up and comes to a stop with the top of the garage door sitting over the bottom part of the L. Parallel with the bottom part of the L (hope that makes sense) and 6inches past the sprinkler head which is now BELOW the door. There is about a 1inch clearance between the bottom of that L and the garage door. Given that the door wasn't settled correctly in its track it tipped down (fell off its track) and caught the sprinkler head caged area. It got stuck pushing against that area. The stress quickly grew along the full L shape up to the Top tip of the L which was connected with an elbow to the long pipe running the full length of my garage lengthwise. As the garage tried to 'fix' itself by closing it pulled on the cage thingy and that was too much pressue for the joint at the top of the L, and It burst open.

When the fireman showed up and they tried to figure out where the water was coming from in order to shut it off they indicated to the apt complex the pipe work was the main reason for this. The door opening, coming off tracks, etc should not have affected the sprinkler system. Hence I say shoddy job. They went to look at an unaffected garage next to mine and informed the apt complex ALL of them were done incorrectly and that given the age of the buildings (7yrs) they can expect this exact type of damage to occur again. You could see from the apt managers reaction that she was bummed by this news.

Still nothing has been updated.

Sorta but I have worked in commercial and highrise apt construction for about 15 yrs....and they would have had to pass an inspection for the apts to be opened....so the firemen may have said it was wrong but it clearly passed code if it was signed off (if it wasnt signed off on then no one would be living there) Was it maybe not the best design yes but I would find it very hard to prove the building owner was negligent and it wil be even harder to prove if you were the first this happened to. If its happened beofre then you might have a shot. I dont know the laws in TX so I would contact an atty there as real estate laws vary greatly from state to state.

Id say your damages are the result of an accident, not the negligence of the Complex. Those pipes could've been in a better spot I suppose, but still.

You prob should have had renters insurance, weather or not it was required, it is there to protect you.

Sorry your stuff is ruined tho, that sucks!
