I need help on how to handle a situation(updated with a pic)

back in oct. i had my cesspool changed, due to sinking. great all fixed no worries right? notChat Icon every time it rains i have been getting a sink hole, called the company that did it and they came once after oih about 2 weeks of calling. came a filled it and said if it happens again just fill it with dirt... not exspecting it to get any bigger right... not... now it has gotten even bigger and for 3 weeks now i have called them and everyday they say they will send someone and have they ummmm notChat Icon Chat Icon Chat Icon Chat Icon i am getting worried with the hole getting even bigger as we head into the rain season around here. i just do not know what to do , i called my insurance company to let them know and they said that i should notbe calling them but the company that did it.....i said i have and nothing.... i am getting no where. is there someone i could call, or something i can do? thanks

Isn't there some sort of warranty on their services? That hole is completely unacceptable!

Tell them if they can't do the job right, then you'll be forced to hire someone to fix their mistake, and give them the invoice.

Send them a certified letter outlining your complaint to see if you can get them to act.

We had a similar problem with our cesspool but it wasn't covered. The ground takes time to settle. They put back the dirt the took out but grading the property was our responsiblity.

Hope this isn't the case with yours.Chat Icon

i took a pic so you can see how it looks. i think this is should be covered because they failed to fill the hole properly... am i wrong?

The ground will probably settle over time, and you will probably notice it more after a heavy rain. If they are required to come back and fill in the holes, have them do it.

yes every time, and this is the worst it has ever been. and i am worried untill they find the air pocket that is causing this to happen every rain,that this is not the biggiest i will see.

Janet, did you have a contract with these guys? If so, look and see if you have any type of guarantee on their work. If they are responsible to come back, I agree with Barbara, send a certified letter, with a return receipt, so you have proof they received it.

Did they figure out why the first one was sinking, or did they just dig it out and replace it?

the contract was with allstate(homeowners) i called them again and they are still not hereChat Icon Chat Icon Chat Icon Chat Icon i had 3 of them. the first one was sinking due to age.the other 2 that they did where not the problem. they collapsed all 3 that i had in the back yard. and put in one huge one. the one that keeps sinking was actually the origanal problem.
i guess i will try sending a letter tomorrow. if i can actually find an address on themChat Icon believe it or not i looked them up today online and nothing, did bbb and nothing and i also looked in the yellow pages and nothing. i am going to try and call my insurance company again and see what i can get done. i am just worried that if this gets any bigger that someone might get hurt.

call one of the news tv stations like "shame on you" and get them to talk to the cesspool company. they'll come out and fix it in no time flat!

That just looks like some normal settling to me. We had our cesspool replaced and there was a much larger area that settled early on. The company came back and filled it in. We developed another small area about like what you've pictured that we filled in some ourselves. It's since settled a little bit more, but not a lot. I would expect it to settle some over the first year or so.

really, because when they told me that it would settle it would not go any more then like a sause pot. i hope they do come soon becasue i do have a small dog and get worried. right now the ground is frozen but when it was not last week, the ground was very soft around it, and i guess that has me a little worried but i will hope that you are very right and that this is normal!!!!! and thanks for putting my mind at a little ease!Chat Icon Chat Icon

but it still does not make it it right that i have called all week long and was promissed that they would come and never did. so that also has gotten me more upset then i should.Chat Icon

That is normal settleing, and with the rain we are having it is normal.

Also the ground will not freeze like the other areas since it is not solid dirt, the cesspool there makes it harder for that area to freeze.
