I think they would get a settlement. I know these six people who survived a plane crash, one of them had a baby whilst marooned at sea. The airline gave them a fantastic settlement! One of them even managed to take over their fathers automotive company in Korea. But it was still sad because one of them wound up in a mental hospital and another one turned to drugs and alcohol.

I would just be thankful for having my life! And I'd be thankful that the airline hired a pilot competent enough to keep us alive!

Personally, if I was in charge of US Air, I would want to treat those passengers a bit better than someone whose luggage was lost. Don't forget all of their documents and electronics in their carry-ons.

I think it could be argued that IF there were warnings of birds in the area (which is a big reason we sit on the runways for long periods of time waiting to take off), there could be a case.

and I can imagine that each and every passenger is going to be experiencing whiplash and sore muscles from impact.

No case if there is no injury, even with that. You have to have an injury and something like this to prove any type of PI case, which, this would most likely be.

Well, they should at least be refunded for their tickets! Knowing airlines, though, they'll probably just get a credit for another flight.

What the airline might give them and what they are legally entitled to are 2 different things. I think that proving negligence would be a tough hurdle. I believe that the Port Authority is responsible for birds in the area. I am sure that any suits would have multiple defendants. I am just not sure that any suits would be successful.

I read that they ARE being compensated for lost belongings and I think they should be compensated generously. I think they should also get some free trip vouchers at least ina ddition to any required medical care, which goes without saying.
