Saying that it cannot compare to the "life sentence" that Rahiem Griffin imposed on a police officer who he crashed into while driving drunk, a Nassau judge Wednesday sentenced Griffin to 7 years in prison.
"This man will not be able to play baseball with his son. He will not be able to pursue his career. That is what you destroyed that day," Judge Jerald Carter said, holding a photo of Nassau Police Officer Kenneth Baribault, who has been severely brain damaged and partially paralyzed since the May 2008 crash on the Long Island Expressway.
Carter said that while he empathizes with Griffin, who will be away from his own three young children for the next seven years, the reality is that when Griffin gets out of prison he will still be able to play ball with his son and take his daughter to a movie.
Griffin, 28, of Shirley, was convicted of second-degree reckless assault after a jury trial last month.
Griffin was returning home after a night out with friends in the Bronx when he crashed into Baribault. The officer had stopped on the side of the Long Island Expressway in Plainview after pulling over another suspected drunken driver.
At trial, prosecutor Maureen McCormick told the jury that Griffin didn't care whom he hurt when he drove into the city on a suspended license that night, had several drinks at a nightclub, and then headed 60 miles home without sleeping.
She said Griffin even continued to drink on his drive home, leaving an orange juice bottle containing alcohol outside his wrecked Mercedes-Benz.
In his testimony, Griffin conceded that he had a suspended license and had had too much to drink to drive safely. But he denied drinking on the road and said he had sincerely believed he was OK to drive. He said he should not be convicted of reckless assault.

Danielle - tears welled up in my eyes for you. I have been following your story from the very beginning. I wish there were more I could do to help you and Kenneth and your family. I hope this brings you some closure.

So glad that he got the max!! I do feel bad for his 3 children; they're victims in this too but hopefully they'll learn from their father's mistake and never D&D.
I heard on the news this morning that he's going to appeal; I hope that's not true.

It's still not enough IMO but it's better than what most drunk drivers get! I have tears in my eyes I'm so happy!

Thank God that judge saw the big picture! Although 7 yrs is no where near "justice" I am thrilled that this POS got the max!

In the beginning of this whole thing, the Judge asked how many children he had and where they lived (with whom and in what state) -- he answered that he didn't know which was strange. We later found out that one lives with the mother and he hasn't seen the child in quite some time and didn't know where they lived at that point because, apparently, they don't have a relationship. Then, we found out that the other child was with their mother and somewhere on the Island - he wasn't sure because he doesn't see that one either.
Then, his girlfriend who he married in jail after he hit Kenneth (his lawyer stated that they did this so she could collect state funds for their child) was like 6-7 months pregnant at the time he hit Kenneth. Now, of course, they baby has been born so I guess you could say that child will have him absent from her life but, unfortunately, the other children did not have a relationship with him -- they said that for court because his lawyer wanted the Judge to feel bad.
It is sad, actually, that he has to lie to "create" relationships to try and make him more "important" or responsible.

It is terrible, but I feel the same way! The truth is that he will be out in 3.5 for good behavior! Personally, I feel he should rot in prision!
I know for Danielle, the sentencing is a form of closure for your family. Now, life can move forward and your brother will continue to make the outrageous improvements in the weeks to come. He is so lucky to have a supportive family!

With the kind of felonies he has been found guilty of - the level of the felony says that he is not eligible for parole before six years. Now, since he is being sentenced to seven - that is seven years after "time served" which is just over a year. So, for him he won't be eligible for parole until he is ready to be released - in six years. That's a good thing - we don't have to worry about him being granted parole too early.
