Judge denies Tankleff's request for new trial


A Suffolk County Court judge has denied Martin Tankleff's request for a new trial and declined to overturn his convictions for the 1988 murders of his parents.

"After thoroughly reviewing this matter, this court reaches the same conclusion that the jury reached seventeen years ago and every state appellate court and federal court that has reviewed the case," Suffolk Judge Stephen L. Braslow wrote in his decision released today, "and that is that Martin Tankleff is guilty of murdering his parents."

Today's decision comes 20 months after Tankleff first appeared in Braslow's courtroom to present evidence he believed would clear him of the 1988 slayings.

Braslow had to decide whether Tankleff and his attorneys, Bruce Barket of Garden City and Barry Pollack of Washington, and their investigator, Jay Salpeter, had amassed enough new evidence that could persuade a jury to reach a different verdict in one of Long Island's most notorious murders.

Tankleff was convicted of two counts of second-degree murder in June 1990, 21 months after his parents, Arlene and Seymour Tankleff, were beaten and stabbed in their Belle Terre home on Sept. 7, 1988. The then 17-year-old Port Jefferson High School senior testified at his trial that he found his parents' bodies when he awoke for his first day of school.

Tankleff, now 34, was convicted largely on a confession that he has said was obtained through coercion by Suffolk homicide detectives.

He is serving 50 years to life for the slayings.

Tankleff and his attorneys presented evidence that they said implicates Seymour Tankleff's bagel business partner, Jerry Steuerman, and two Selden men, Peter Kent and Joseph Creedon.

All three deny involvement in the murders, but Tankleff's attorneys have said that Steuerman ordered Creedon -- who was a drug debt enforcer for Steuerman's son, Todd -- to kill the Tankleffs.

Tankleff's attorneys cite as a motive the fact that Steuerman owed Seymour Tankleff about $500,000 and that Tankleff had demanded some of it back.

This is terrible. This poor man, deserves at least another trial. I really do not understand this. This really saddens me.

from everything I had read this is so much evidence to free this man, and yet they cannot even give him a new trial. Something is definately not right here.

i think it was ok...

they tricked his azz...
and he confessed...
i see nothing wrong with it..
and the things that came out of his mouth...

He admitted to doing the crime, this was thoroughly investigated at the time. At the time of the trial, the defense and prosecution were aware of his father's business and personal dealings. The prosecution did not find it credible and the defense didn't pursue it.
Enough with this. He was a spoiled, little brat who couldn't get what he wanted. Now he has what he deserves.

He went on to tell the detectives a chilling story of how his displeasure with his parent's constant fighting and his sense of being under his mother's "thumb" became too much for him. Among his complaints were that he was not permitted to play contact sports, he lost his boating privileges and that he was being forced to drive "the crummy old Lincoln" rather than a sportier car. His parents were upset that he did not complete a list of chores.

Most of all, Marty feared what would become of him if his parents, who adopted him at birth, divorced. He acknowledged that if both his parents were dead, he stood to inherit a large amount of money.

Then came the confession. According to McCready, Marty described waking up about 5:35 a.m. attacking his mother first with the bar of a dumbbell from his bedroom. Naked to avoid getting any blood on his clothes, Marty claimed he struck his mother four or five times but she fought back, yelling, "Why?" and "Please help!" Arlene Tankleff fell off the bed and Marty ran to the kitchen and grabbed a knife next to a watermelon, which was then used to cut her throat, according to McCready's account of the confession.

Still naked, Marty hid the bar and knife behind his back as he confronted his father, who was still seated behind the desk in the study where the card game was held.

"What are you doing?" Seymour Tankleff asked Marty, according to the police account of the confession. Marty went on to describe knocking "him silly" with the barbell before cutting his throat.

McCready's report winds down with Marty Tankleff describing how he then washed off blood from himself and the weapons in the shower, and putting the weapons back before getting back into bed. Marty agreed to give a written and videotaped confession but police never got that far.

Just read todays newsday and i am even MORE convinced that our justice system works..


New trial? For what? Chat Icon
He got his trial and was found GUILTY.

And the "new" evidence is beyond flimsy.
