Maternity Leave question

I know each company is different; mine does not have an HR department to ask so I just wanted to see how others have handled this.

Even though we are less than 50 employees, my job offers FMLA. I had to sign a letter today stating that I have up to 90 days of leave and need to notify them when I’m ready to return to work. If they do not hear from me prior to the expiration of the leave, they’ll assume I do not intend to work. They will hold my position for 90 days, commencing on the date I start leave.

My question is – I have 2 weeks’ vacation and 1 week sick time. Can I use that time to extend my leave or does it have to coincide with my leave? I know this will be depend upon each company but I want to see what other places do. We have no handbook or procedures in place here.

FMLA just states they will hold you job for those 90 days- it does not indicate how you will fund those days- be it sick time, paid maternity leave offered by your company(Not many companies offer this anymore) vacation time, or unpaid.

FMLA will hold you job (or a comparable one) but i has nothing to do with your personal time.

So you will have to use your personal, sick and vacation days to fund your time off from day 1.

That is something your company would decide. In my previous company I tacked on my vacation time but I had to okay it with the CEO. Ask them.

For me, my FMLA short term leave does not kick in until a week after I leave work. I need to use PTO for that first week (we don't get sick days, for me it's all the same PTO) and then my FMLA benefits will kick in. So in total, that would be 7 weeks off for me, 1 week of my PTO, and 6 weeks of short term disability leave.

Just bear in mind that short term disability from the state is less than $200 a week I believe. It's not your full pay.

Usually it is 90 days total (or in my case 12 weeks) - and you can use sick, personal, vacation to get paid for some of those 12 weeks.

It's really up to your company to decide if they will allow you to use that time or not. They can either say yes or say no.

For my office, the first I believe 60 days of maternity leave are paid. We can take up to 90 days, but after the 60 days, we need to use our personal time/vacation time to be paid for it. Otherwise, it is unpaid time for the last 30 days.

ETA: I had another question... they say 90 days and it's 90 regular days, not 90 business days. Are you paid for weekend days as well?

FMLA is not paid - it's just a guarantee that they will hold a position for 90 days.

Basic State STD is $170 for 6 weeks vag delivery, 8 weeks CS with a week waiting period.

I'm not talking about pay, I'm talking about if there are any guidelines if vacation and sick can be used AFTER FMLA.

If I took a vacation this year, then I would have had my 90 days AND 2 weeks paid vacation.

**I think I just answered my own question as to how I will go above asking for additional time if I think I need it after my 90 days.

My goal is to come back after the new year and start fresh. I will be one week short if I go out on my scheduled induction date.

Hmm, I don't think my STD is covered by the state but in any event, my company calls it FMLA leave (looking at the booklet now). Mine is full salary continuation for 6 weeks and then they give us an additional 9 weeks fully paid leave. So in total, I have 16 weeks paid maternity leave (week 1 is either unpaid or supplemented with PTO) with guarantee that my position will stay open for the entirety. I'm sure not all companies work this way but this is my experience.

It's up to your company. Some companies will extend your time off if you want to use your vacation days then. Others won't. That's not a law, just company policy.

Yeah, wow.
I got NOTHING.
I had no vacation time either since I just had started there so I had to take 8 weeks UNPAID. That was all I could afford.
I went back to work after 8 weeks and I got nothing (other than the measly state disability)

For me, it has to coincide with my leave. My first 6 weeks I have to use sick time and the second 6 weeks I use vacation totaling 12 weeks. So they're not "giving" me anything, it's all my time. I actually only get 6 weeks vacation per year, so there goes all of it. If I didn't have so much time I'd have 6 weeks disability and that would be it.

I also learned yesterday that I cannot submit my paperwork until 30 days before my due date. I can only imagine what a nightmare it must be to go early.

Yes! It's a CPA firm in Manhattan. But there are open positions for CPAs, marketing and HR professionals....

Same here but one thing for us is you have to be at the company one full year before getting fmla or leave. If you have insurance through them you can take std for 6 weeks fully paid but after you take one week of pto.

At my job, you get 12 weeks off for FMLA. If you have vaginal birth, you get 6 weeks paid. If you have a c-section its 8 weeks paid. The remainder of the time (until 12 weeks), you use your vacation time or take as unpaid. If you don't come back after 12 weeks, your job is no longer held for you.
