Might loose the house we are in contract for
OK so the seller is having problems with us since we requested that she close a pool permit which was opened (there is no pool) and get a proper CO for a dormer (apparently she has one for the shell but not for the rooms i think?) She is getting frustrated at all these things that we are asking her to settle before closing and we are afraid she is going to back out. There is a little more to the story, (like her attorney is an idiot and making this woman crazy!!) but i dont want to bore you with the specifics.
We signed the contract, but she has not. I keep on telling myself that if its meant to be, its meant to be but we love the house and the location, even started planning what we were going to renovate first and it just seems like our dream is not going to be a reality. Ive already taken time off work to go to the inspection and we are going to sit down with a mortgage guy this weekend...I just hope all this is not for nothing!
Has anyone else been through a similar situation???

I have not been in this situation, but like you said, it will work itself out. I know you are frustrated right now but in the end you will be happy with the results.

When we were looking at houses one of the houses we liked wouldnt get a proper CO for the garage they made into a room. We walked away, to us they were shady and we just didnt want to get involved in that and besides didnt want to deal with our taxes going up.

We were in contract for a house and the seller was giving us issues about getting a CO for the garage conversion and deck. Also their attorney was very nasty and was very rude to our attorney, so she recommended not to continue with the deal, so we backed out. We eventually found another house.
ETA: this was after we had already had the inspection. It was VERY frustrating and upsetting esp since we had wasted $ on the inspection.

a few yrs ago we put in an offer on a condo, the seller was a real azz!
he had an illegal deck w/o permits and refused to tear it down.
we backed out. and it was the BEST decision! we would have ended up buying at the absolute HEIGHT of the housing market and would have been stuck with an over-priced condo.
so, I thank GOD the seller was an azz!

if she doesnt sign, then shes an idiot, JMO. because if its not going to be you that requests it, its going to be the next set of buyers kwim. she'll HAVE to get it done sooner or later to get the house sold so she might as well do it now and not waste any more time on the market. banks are strict nowadways with CO's and permits so regardless of WHO buys the house, she'll have to get it done.
sellers like this really pizz me off. they dont realize how good theyve got it till its gone.

This happened to friends of ours when they bought their house. They used the money is Escrow to get all the CO taken care of once they were in the house. They had problems with the garage, deck, apt in the basement and a few other things. Once they would fix 1 thing an inspector would come and find something else wrong that needed to be taken care of. It was a royal PITA and they said they would NEVER recommened it to anyone

You can always hold money in escrow at time of closing and give her more time to clear things up. We did it and it worked out.

We were in a very similar situation, we just hadnt signed the contract yet. The guy had done all this work on the house himself and didnt bother to get any of the CO's, which we found out after the inspection. We didnt want to wait until he got around to getting the CO's, plus our taxes would have gone up and we had no idea what our costs would be until the CO's were done. Unfortunately we were so emotionally invested in the house by this point, so it was devastating when we had to pull out.
BUT, we are so thankful that we didnt get that house, because we found a house that we liked even better, which we now own!

Oh yeah. We were told the extra rooms and basement had the COs.. because the seller LIED to his RA and lawyer.. literally two days before we were to sign the contracts suddenly everything changed and they couldn't get the CO for the bedroom without the basement being fixed to get its COs OR unless we ripped it all up
We should have walked but we didn't, we had no clue. We ended up getting some money from them so we could fix the basement and get the COs, but it was a PITA (needed a varaince as well) and 5 months later we're still going through the process.
There are several reasons why we shoulda walked, and I wish we had sometimes! Good luck!!

This is good to know because we were considering doing this. I was talking to someone about it today and they advised we dont do this because you are just inheriting other peoples paperwork...

Do not take the house without proper CO's. When we bought our home the owner was getting the co's for an extension she put on. Everything turned out ok for us and she got the CO's in time but she had some help getting them pushed through the town. We refused the house without CO's because you will have to legalize it at some point. If it was not done correctly things will have to be taken down. It has to have the correct amount of outlets or you will have to add more. The windows have to be a certain minimum size. Let the owner pay the arch to draw up the plans and pay for all the inspections. You should not have to.

This happened to us, but they did get the CO's in the end. We had to wait for their lawyer to take care of everything, but they were able to get all of them, so sometimes these things work out, but if they are not willing to get the CO's taken care of to sell their home then I might walk away. A lot of banks won't give you a mortgage unless all these things are taken care of before hand. GL! But if it does fall through, then it wasn't meant to be and maybe it was for a good reason. There will be another house......a better house if it doesn't happen. Lots of luck!
