Mommies that use in home daycare
Does your provider claim the income and allow you to claim the childcare expense on your taxes? Just wondering what the norm is

My in-home daycare is run more like a facility (different programs/classes, newsletters, outings, monthly receipts etc). In Jan they provided a form with all the tax information on it.

Yes, she does. She gave me a letter with the amount we paid and her social security number.
He only goes there 2 days/week but that's still a decent amount of money we can claim.

I think I am going to ask my provider about this
she kind of runs it like a daycare in that we pay her for major holidays when she does not watch the kids, I think if she is running it like a daycare, we should be able to deduct the $$ like a daycare

I am a NYS licensed family provider ( on an extended maternity leave ) and I have always given my parents a letter in January with my TIN and the amount that they payed that tax year

honestly, I would expect to be paid more then.
I was blindsided with this. Completely unfair.
If its not discussed up front, then everything should be up for discussion, including pay.
Also...you may want to consider offering to pay her employment tax.
This is a very touchy subject.
I agreed to give my ssn number after she kept asking for it...I only did that when we dicussed her paying my the amount I was going to be taxed. What's fair is fair...why should I babysit one month free and clear???
Well...tax time comes and goes...I give her the figure, she forgets all about agreement. Okay, good luck next year!

yeah, she actually asked my friend who also uses her if she was going to claim the deduction for 2008. She did not mention anything to me. My friend said not for 2008 cause she did not have the correct records.
I just feel that she should not be getting paid for days she does not work unless she wants to play by the "daycare rules" all around
I am not sure what we are going to do yet.

If it is a licensed daycare, they have to allow you to claim them. They have to pay their taxes. If she was not going to allow you to claim her on your taxes I think she should have been upfront with you.

I think you can claim it as an expense, if she claims it as income. If she works off the books you can't.

My provider is NYS licensed and insured. If they are approved by the state then they have to let you write it off on your taxes. There is a form she should give you at the end of the year so when yo file you have all your paperwork.

The credit amounts to a very minimal credit. Yes you can claim up to $3k for one child 5k for two, but that's not a deduction and that's not what you are getting back. I forget what my credit was for 6k worth of childcare, but it was around a couple hundred dollars. So if your provider is inexpensive and you don't want your rates to be raised to cover her self employment taxes and taxes on her earnings (which would likely be more than the credit) , I would just leave it be.

I think it may turn out to be more if you use flex $ if you company provides it.

No I don't claim her....we never discussed it and honestly I don't think for us its worth it. We pay her for the full week ($200 for 4 days) whether DD only goes for 1 day or the full 4 days. She takes excellent care of DD and I think I have a great deal. IMO depends on how much you pay.

Our lady is licensed through the state (I'm in IL) and insured to watch the kids, she's running a business IMO so there should be no shock that I'm going to deduct what I pay her.
If the person didn't have a formal business and was just watching my kid, I can understand why there was would some confusion if it wasn't discussed before services started.
