so what do the cops consider asault then? If he was killed??? Thats totally ridiculious, the cops should have arrested the dirt bags, mental issues??? then send them away to a clinic.

first off, i'm sooooo sorry this happened to you - i wish he hadn't given a flying flea who it was and just knocked her right upside the head!! but, i have to open my mouth because it gets me sooo bad when people say things like "what do the cops consider assault" and why didn't the cops do this that and the other... granted suffolk is a little different than the city, but new york state law is what it is... first off, there is nothing such as "assault and battery". the cops can only go by what the law states... and i understand that's really frustrating for a lot of people because it doesn't always seem just or fair, or make any sense. but, if a cop chooses to make an arrest and charge someone for something (such as assault, when it is really only harassment according to the NYS penal law) then when the person gets out of jail, if they have a lawyer, they will turn around and sue the cop for wrongful arrest and have their job. no offense to anyone, but i'm not willing to lose my job for ANYONE. according to the nys penal law, assault in the 3rd degree, which is the lowest form of assault - there has to be a visible physical injury. so, even if someone slaps you, pushes you, kicks you, rips your shirt, shoves you into a wall, etc etc - it's still harassment, until there are visible cuts and bruises etc. the OP said that the cops are letting him press charges for harassment... is he just filing a report or are they arresting the people for it? because technically, harassment is only a violation and someone can only be arrested for it if it is committed in a police officer's prescence. also, it is VERY hard to arrest someone who has a mental disorder, the way they are claiming these people do... generally, at least in the city, instead of arresting people like that - we cuff 'em up and bring them to the psych ward. unfortunately though, it's the staff at the hospital that releases these characters and lets them roam the streets. people should not be released from psych wards if they are a danger or a threat to others. anyway, sorry for my vent... and i really hope that the cops are able to help your brother somehow... and i myself, will not be hitting that 7-11, unless i am well armed

Definitely press charges. They should also be mandated to treatment if they have a violent history associated with their mental illness.
Not that that always works (another thread!) but at least they can (should) be monitored more thoroughly from the mental health world and even brought in to be evaluated if they are not following their treatment orders.

i'm also a city police officer, as well as dh, and it also bugs me when people don't really understand the law, and what "assault" really is...I couldn't have put it better myself, but in any case, I'm sorry for your brother and hope that doesn't happen to anyone else. Also, stay on top of the police. Whether it's just harassment charges, it's something on their record.

I have to say that what both of you are saying is really upsetting me.
What it really means is that some wacko can attach anyone, anywhere, push us around and it's just "harrassment" if we dont' have a bruise or scar. How scary!
Thank you for telling us what the law really is. I guess there is no real protection for the "normal" people who just mind their own business.
I guess our concept of assault if VERY different from the Law. Wow.. just wow!

He actually has deep scratches on his chest, I took pictures of it. He was going to talk to the police today but I haven't found out the outcome yet. I just don't want these whack jobs finding out where we live (My brother is staying with us for a while) I have two small children here.
BTW It was the 7-11 on Boyle, not Middle Country. So continue to enjoy your coffee whack job free
ETA: The guy tried to hit my brother with his car too. To me that seems like it should be a tougher penalty than harassment.

So talk to your legislatures!! the definition of assault CAN be changed. But people need to DO SOMETHING. Talk to your elected officials. Make some noise. Get some press. This is a big election year and no one wants to be seen going soft on crime.
