I agree with a lot of the points. But I never wanted to resign. I still don't. Although I don't think at this point that it will happen. They sent me an official letter informing me that I would lose my job. And with such situation, how could I work there now. The audit of the daycare violations is totally legit and public record.
I originally requested to be off until the end of the year since a lot of daycares did not have any openings until then. Then we were able to secure a place for October 15. I was due to return in Mid-Sept. They asked me to meet them halfway. I thought I did from my original request. They even asked me about telecommute but then retracted. The manager said she did not think I could do it with DC at home after she asked me the same morning to think about the logistic and how we could make it work.
This is so stressful. Especially when I thought I went from requesting several months to a few weeks.

I am so sorry that you're in this position. as someone who worked for a company that did everything by the book, I understand why they're doing it. they're protecting their own interests, not yours. sadly that is the norm in corp. America (for the most part).
I hope you find a resolution. and this is JMO but I would not hold it against them. they're protecting their interests just like you are doing for your child.
I wish you had a family member that could watch your child for a few weeks before starting the new daycare facility.

I'm so sorry - I can't offer much advice but I think this is disgusting that you are going through this. maybe its all for the best - it sound like a c rappy company for a woman to work for, and your talents could be appreciated elsewhere.
Can't men get FMLA as well? Can your DH or So help out?

Not having childcare makes you eligible for unemployment. A co-worker was in a similar situation and it was granted. Really? I wish I knew this earlier....I took a p/t job to get off unemployment after being "bullied" by the chick at the DOL.

That's the first thing we tried.
- DH got a new job (and used all his vacation when DC was born) - He brings most of our $$. I already lost 9 weeks of income between FMLA and this situation. He cannot take any time unpaid.
I feel people/work think we are not trying. I am barely sleeping at night. I just can't leave DC to anyone to be looked after. Especially with the news on TV about abused kids in daycares.

If you truly want to keep your job, show up on October 1 with DC in tow. That's what the letter says right - be back 10/1 or lose your job?? Doesn't say show up alone does it???
Bring a pack & play and anything and everything else you need to have DC in the office with you for the day. Then let them try and fire you over two weeks w/out daycare.

I like this idea!
I told them I was going to do that.... they told me it was totally unacceptable.

When I "left" (I'd say was fired) from my job- they refused to package me out and they told me I wasn't eligible for unemployment. Please let me know if you find anything else out about this. I haven't pushed the issue, but I still thing they were wrong. In the process of my being out on the FMLA, we had to move over 2 hours away from where my job was- and even though they have an office less than 20 mins from my house, they told me there were no jobs available and gave me the same ultimatium that your co. gave you. Good luck!
