I agree that this is a complete blessing. If I remember correctly you hated that job! Now you get more time than you would on disability and nearly (if not more) in pay on unemployment. I WISH I would be fired at 38 weeks! Perfect timing and I'd sit back collect unemployment as I enjoy my baby! You are lucky and I am envious!

Wow...I'm an employment lawyer who represent management and am highly sceptical of most employment discrimination claims. However, I can't believe this, especially since you work for lawyers.

Question: Does your company have a paid maternity policy? I suspect he is trying to welch out of that obligation and fired you for a lame excuse. Thus, the reason for firing you may be pretextual and constitute pregnancy/disability discrimination.

Talk to a lawyer!!!

What a pr!ck. He cannot fire you without written warning first unless you break the law. He cannot fire you for something not business related. HE is TOTALLY screwed IMO for doing this while you are PG & out on FLMA.Chat Icon



DEFINITELY save that voicemail and any other incriminating correspondence from him. (emails etc.). You may want to speak to an attorney or threaten to sue him for discrimination. He can't fire you over the phone - you need some sort paperwork and they have to pay you for any unused vacation/sick time you are eligible for. He was clearly itching to do that to you. #2 He is a real jerk - would you want to work for someone like that anyway. you'll find something else.

Unfortunately, there is no HR department at my job. It is a small law firm and I have no contract. I also do not qualify for FMLA and wasn't even on disability yet, I was using accured sick and vacation days (which I am happy that I used).

Also, they are liars (I've been in the room when things have been blamed on former employees so that my other attorney wouldn't get in trouble) so even though in his voicemail he fired me for not doing a personal thing, I am sure they will come up with plenty of things to blame me for. Which is what actually hurts the worst, I put a lot into this job for 3 years and this is the payback.

But I think in the long run that it is for the best, we wanted to move back to LI and now we can without having to worry about my commute and I can spend more time home with my son than I would have on disability.

I am saving the voicemail and whatever else I get in the mail from them either today or tomorrow and we will see where it goes.

I thought you were on on FMLA/STD if so he'd be screwed. I am so sorry. I hear such horror stories and being someone who is on STD and worried about being terminated I know how u feel. However I have to agree that my mindset is if I get canned after my FMLA runs out (They swear we have never fired anyone on diability BUT....) I will gladly take unemployment and be with my munchie for 6 mths instead of 12 weeks. Unfortunately there are no laws protecting your job while you're on STD. You're entitled to the STD benefits, but your employer doesn't have to hold your job open. FMLA is the only thing that provides job protection. However, an employer can still fire you while on FMLA if the firing is completely unrelated to your leave.

Kate- I was let go/fired from my job 2 years ago. I wasn't pg at the time, but they told me they were "restructuring" WHATEVER! I know the truth....

I'm currently freelancing and haven't landed a permanent job yet... turns out that each freelance pos. I wouldn't want perm anyway. This is a small blessing, compared to the big 7lber you're about to have Chat Icon Chat Icon Chat Icon Chat Icon

Edited to add, I freak out b/c once this freelance assignment ends and I'm ready to have this baby.. I'll be unemployeed w/ NO unemployment! Talk about FREAKING OUT............

It totally sucks that this is the way they would handle the situation, over the phone! Tacky! Be glad it was only 3 yrs. you gave them and not 10!!!
