Problem with seller's realtor- what would you do? Long- sorry

We are having MAJOR issues with the seller's realtor right now to the point that we may not purchase the house. We just received the contracts Monday night. The seller's lawyer didn't mail them until last Monday night, when there wasn't any mail. Our lawyer got the contracts 2 days later and mailed them out within 2 days. We contacted the realtor to inform her that the contracts were not correct (they didn't state the seller's exclusions and we wanted to be sure that the contracts were correct) and explained that we wanted to do the right thing. She stated she understood this. Yesterday, she calls DH and in a nasty tone asks "Why is this taking so long?" in regards to the contract. DH was livid, as he explained to her the night before that we just received the contracts that night. He mentioned that we were trying to make sure that the seller was protected and that we didn't want to be azzholes about things (washer/dryer are supposed to be excluded but we could have not mentioned anything and tried to keep them). He also informed her that we wouldn't be spoke to rudely. She backpedaled and apologized. We also didn't realize that we needed to send a check for escrow then (I missed the cover letter from the lawyer because I felt so rushed to ge the contracts out) and needed some time to transfer the money. The realtor told DH that they would accept a personal check and just to let them know when to put it in the escrow account. I wasn't sure who to make the check out to, so I called the realtor and asked her to get back to me ASAP so that I can mail everything. I didn't hear from her so I made the check out to the seller (again, I didn't see the cover letter because I just wanted the contracts out) and mailed everything yesterday. When I found the letter I realized that the check should've been made out to the lawyer. DH calls the realtor about 2 hours later and asks what she would like to do. She never called back.

Today I called her and left a message explaining that we were upset with her treatment and that we had some serious concerns. She has yet to call back. I understand that people are busy and have lives, but it's been about 30 hours and she has yet to return one phone call. We're at the point now where we don't want to do business with her, as we don't want to be treated rudely. We've left 3 messages and not 1 acknowledgement.

Are we overreacting? What would you do?

I know exactly how frustrating this part of the house buying is. Our contract was dragged out for nearly 3 months.

One question before I go on: Do you have a realtor yourself? Or are you doing this yourself?

We're doing this ourselves. It was smooth until yesterday. DH is still fuming from the way the realtor spoke to him. She was rude and disrespectful.

Seriously, do you have a lawyer? Youu should at least have a lawyer helping you right?

from what I was always told by our lawyer, was that we were to go through him with anything we wanted not the REA. So I would say you should call your lawyer up and ask him to speak with the sellers lawyer and have them make the changes. All these changes are up to the lawyers to take care of not the REA. As long as you & your DH wanted these things in the contract and the sellers were ok with it, then the sellers lawyers is responsible for getting this done. This was my experience when we bought our house 6 months ago. I hope everything works out for you. And no I don't think you are overreacting, the REA shouldn't be so rude and should have called you back if she wants to make the sale on this house. JMO! GL!

call your atty first thing tomorrow morning and explain what happened. i suspect he might advise you to stop payment on that check....the check really should be made in your atty's name, as it should be deposited into his escrow account.
if i were you, i'd leave the realtor another message tonight, explain your error, and that you'll be contacting your atty first thing in the am to send him another check which will be made out correctly.

EXACTLY!!!!!!!! Our lawyer did it all. Even let us know who was doing what and who called who, etc. All we did was sign papers.

Also, there's a chance something could've happened with that realtor. I know it's frustrating to not hear anything. The realtor selling a friend's house actually had a death in the family and went out of town for a few days. Although She should not have spoken to DH that way, but you never know what just happened in their lives. (Considering you said you hadn't had a problem in the past.)

We've left her several messages and have yet to hear from her. Initially, we left her messages to be nice and keep her updated. However, since she's been rude and disrespectful to DH and DH informed her that he will not be spoken to like that, she has not returned any phone calls.

I also left a message for our attorney.

Hol - I've been through similar situations. At this point, it is best to leave all discussions, negotiations to your attorney. Even if it takes longer or drags it out. This is what you are paying them for.

Even though I loved my realtor, at the end - I didn't discuss any of the issues with him because it was between the lawyers. At this point, thats what you need to do because this is for the attorneys and not the realtor.

If you love this house - don't walk away. But, make sure you are protected - you may need to stop payment on that check and allow your atty. to advise you.

It's a long process but worth it.

If you love this house - don't walk away. But, make sure you are protected - you may need to stop payment on that check and allow your atty. to advise you.

It's a long process but worth it.

Thanks ladies.

we are so confused. we mailed the contracts to our lawyer along with the check, so there is no way that they'll get it. We're going to contact our lawyer and tell him to hold everything. After hearing what you're all saying, she should have never called John and complained that this is taking too long. The reason why it's taken this long is because of the seller's lawyer, not us.Chat Icon

Sorry you're dealing with this Hollie. We had so much difficulty when we were going to contract. It took over a month, due to a ton of miscommunication. Basically, our lawyers weren't communicating at all and we were playing this awful game of telephone from the seller's lawyer, to her REA, to our REA, to us, to our lawyer. As the other ladies said, have everything go through your lawyers. MUCH easier that way!

Remember, she is not your realtor. Try not to let her get to you. This is YOUR house and you want it. Leave it all up to your attorney. We only taked once with the sellers realtor throughout our process.

The other thing is that the "players" in this sale will always play an emotional role on you.

I had MY realtor complaining to me that I was taking too long, that we were losing the house and I told him to not worry about it. This was during the renegotiations after the inspection.

On my first purchase I had the seller (FSBO) complain to my husband, etc. etc. and on my recent sale (FSBO) I was being driven crazy by the buyer.

I even had my lawyer yelling at me on my first sale --- I tell you, I had it bad twice! LOL.

There are definitely times when you throw in the towel - but not over emotional issues or being annoyed that someone is rude. These things take time and if THAT realtor doesn't know that (or is asking for their client) then that's crazy.

Being that she has such an attitude problem - don't even waste your time calling her. Cut her out of the mix all together - you'll see how nice she is when she needs to call you for things.

I would NEVER in a miillion years speak to a buyer that way - AND - she is getting BOTH parts of the commission - she should be working her azz off to make sure it goes smoothly.

Don't let her ruin getting this house.

Go through your attorney for EVERYTHING from now on.

I agree with what everyone else is saying. She is the sellers Realtor and unfortunately she owes you nothing. It's absolutely ridiculous because she is trying to get the house sold ultimately, but we had the same situation with our house. We had no realtor and just dealt with the builder's realtor.

Things got beyond heated on so many situations. By the end it was decided that we would only deal with her in writing and through our attorney.

But I will say that now that we are in the house I am so happy we stuck with it. It was really worth it even though we were ready to walk away a few times.

Sorry you are going through this Chat Icon but do not feel rushed and take your time reviewing everything. Also, next time you have a question about something, ask your lawyer. He's being paid by you to advise you and he will be able to answer any questions you have.

I agree.

get your house and then throw a pie in her face!

if she's a nasty person...there's nothing you can do about it. except, call her on it. but if you like the house and want the house, don't let her nasty asss dissuade you. after it's said and done, you'll never have to deal with her again...so why let her attitude interfere with your life!

better still is maybe write a letter or something AFTER you purchased the house to her company...this way whatever happens happens ONLY to her, and doesn't take your house away from you.

Holl...I'm sorry you're going through this. We too only went through the seller's realtor, but told them straight out we had a bad experience w/ the prior realtor & we dont want a repeat performance.

They were nothing but SUPER nice to us...YOU (WE) are giving them a MAJOR commission...the LAST thing they should do is be rude to you.

It depends on how much you love the house Hollie...is it worth losing the house over?

Also like the others said, at this point EVERYTHING should be handled through the attorneys.

it sounds like your sellers realtor was our realtor.. im convinced our realtor is the reason we didnt' get our first choice house... she's completely nuts, abbrasive, and plain rude....

if you really love this house.. just grit your teeth and have your lawyer or realtor talk to her exclusively.. i had to stop talking to our realtor b/c she was insane (long story why we had to keep her)....

don't worry it will all be over soon and then you will be nice and settled in ur new place
