Question about selling home with semi inground pool
We are thinking of listing our home. We are in the town of brookhaven. Had a semi inground pool installed a few years ago and the company we bought it from told us we didn't need a co. A realtor we spoke with said we do. Does anyone know or have dealt with this before?

In all townships that I know of, you need a C/O for all types of pools, even those that are fully above ground. Most people don't get them, but with an above ground pool it's easy enough to tear down if it becomes an issue. With a semi inground pool, and an inground pool for sure, it is harder because you can't just tear it down and often you have decking and stuff built around it.
I would consult with an expediter to find out what it would entail to get the C/O (cost, etc.) and if there are other issues on your property that can present an issue (because if the town comes in to legalize one thing, they will often find other violations). It can open a can of worms. If it's really going to be a long and costly process, you can also look into the cost of removing the pool and fixing the yard, just to have all of your options.
If you don't want to get the C/O, you can list the house and deem the pool a "gift" letting people know that you don't have a C/O and don't intend to get it. Certain lenders may overlook it (and obviously a cash buyer would avoid the issue of a lender refusing to give a mortgage unless the C/O is in place), but you may shrink your buyer pool.
You can also take the position that you will get a C/O only if it becomes an issue for the mortgage. But again, buyers may or may not be willing to accept that.
Basically, I would look into it, get all of your options and weigh them out, and then discuss with your listing agent the best way to proceed.
Even if you decide to have the expediter get the C/O from the outset, you can still list the house and just let people know the C/O is in the works.

You now need a permit for all pools in Brookhaven. In ground more than 18" needs engineered stamped plans, above ground pools just need specs. All pools will need an electrical cert. And lastly in Brookhaven Town zoning setback needs to be 15' from all property lines. Feel free to fm me, I'm an expeditor for Brookhaven town
