Question re: engineer report & current owners- help!

so you may have seen my previous post. I told the current owners keep the house- we don't want their problems to become our problem...
well now get a call that their lawyer wants the copy of the engineers report...and that they'll "work it out" with my lawyer...
Um- won't I have to pay my lawyer for that? I'm already 415 down from the engineers report if I don't take the house.
why pay my lawyer to do the negotiating that I can do on my own...
am I wrong here???

No, that sounds right.... the attorney usually won't charge you unless you close.

I would ask your attorney if this is how he works it out or not. Our attorney did all the neg. after our engineer report and everything turned out well and we only paid him what he told us he charges at closing. HTH! GL! Chat Icon

hmmmm...good question.

We had a few minor issues on our report - but since its a buyers market we made them fix stuff- they never asked for a copy.

maybe only give them the pages that specifically refer to the problem?

hmmmm...good question.

Our attorney never charged us until we closed....FM me if you want his info, he's in Westfield.

I would speak with your attorney. If I remember correctly, you are not obligated to show the seller the Eng report.

The engineer's report is public knowledge even though they paid for it. If you won't give it to them they will ask the Engineer to give it to them and he/ she can't say no.

You are not obligated to show them the report you paid for. Especially if you have no intention of buying that home and are moving on, let them get their own report.

Call your lawyer. I would NOT hand over the report esp. the whole report. MAYBE just the pertinent parts. Also, if the attorney has done work and the deal falls through, some attorneys may charge. You should talk to him/her about that.

Yes having two engineering reports done for me in the last three months, this is true. I was told by both guys that this becomes public knowledge and if the homeonwners, lawyers ask for this they have to hand it over. Think about it, it there is work that needs to me fixed, how would the homeowners or their lawyers know about this or even offer a settlement without see the report.

Our attorney took a copy of our engineer's report and he used it to negotiate which repairs the owners would do. He didn't charge us extra for that- it was part of the service he performed. You might want to check with your attorney.

we walked from a house we had an accepted offer on when the engineer's report came back. It was FSBO and we were only in the beginning stages of talking to lawyers when the seller asked for a copy of the report. we were walking regardless and he knew it. i understand why he wanted a copy of the report but i told him that if he wanted it, i'd split the cost of what i paid to get it with him. suddenly he wasn't interested anymore.

I am going to fax the report to MY atty tomorrow and he could decide what he thinks is best to send to the seller's atty- but I'm certainly not going to fax the whole report to the seller.

If you are absolutely sure you don't want the house - then don't give it to them.

If you are interested in renegoitating, then send it to them.

I sent them ours (in fact, they gave us their own report too) with a line by line item list of what I wanted fixed/changed, etc. Then we negoitated a big dollar amount from there.

absolutely. do not send anything directly to the sellers attorney or seller, have your attorney handle it.

however, if you REALLY dont want the house anymore then i dont see the point in having them discuss the report at all.
