Quick maternity leave question

I'm not sure if anyone knows the answer but... if I tell my company I don't plan on coming back to my position (management) after the baby do I still legally get my 90 days full maternity pay leave? I would be taking it the middle of September, so the year would be almost over. I don't want to screw myself out of the money or screw my company. I'd like to talk to HR but since it's a small company I don't want anyone to really know yet, and somehow use it against me.

I think many companies are used to new moms not knowing exactly what they are doing, or changing their minds. So, don't tell them exactly that you don't plan on coming back. Start asking simple questions about your medical benefits, etc.

Then ask questions like 'I know some new moms try to take on so much and then change their minds about coming back. Will I be penalized if I do decide to not come back, or come back part-time?' Throw out BS, even if your mind is made up, they don't have to know. I know some companies actually make you pay back your medical benefits if you decide not to come back. It always helps to know every option to make an informed decision. Chat Icon

They aren't legally required to give you a 90 day paid leave (unless they are contractually obligated).

They are required to give you disability (6 weeks, V-birth; 8 weeks C-birth). However that is once you are "disabled" (give birth). Nothing would prevent them from terminating you up prior to you going out on disability.

I agree to try to get the answers without informing them of your decision. Towards the end of your pregnancy, start talking up trying to find daycare for two & what your options are.

This is what happened to me. I had 23 days sick/vacation time saved up and I started taking them prior to DS's birth. I had two days left when they terminated me. I hadn't even started my disability yet.

Sorry to hijack but if you don't tell them and you decide not to go back, do you have to give notice or go back for a week or two.
