Reporting an accident to DMV?

We had a minor accident last weekend. We got an accident information exchange report from the officer at the scene and just called the local police dept today for a copy of the actual accident report as our insurance company requested it.

I just noticed that on the top of the accident information exchange report it says that you must report all accidents that result in more than $100 worth of damage to the NYS DMV and that failure to do so is a misdemeanor???

It said that a police report is not enough.
They give a website to go on and do it, but I had never heard of this before and I had an accident a few years ago.

I always thought the police report was forwarded to the state DMV and DH thought so too from his years as a cop.

Has anyone heard of this?
I never reported mine 4 years ago, and nobody came to arrest me. Chat Icon
Is this going to be an issue when i go to renew my license or anything?

I'm very confused by this.

wonderful. I never did this for my accident.
I had no idea.

We'll do it for this one, but I don't get why the police report can't just be forwarded to the DMV. It has all the information.
Super annoying and the last thing you need to worry about when dealing with insurance, body shop, car rental, and all the other crap that goes along with the accident.
Not to mention we were 100% not at fault.

Why does DMV even need to know that some douche bag threw his truck into reverse and floored it backwards into us at a stop sign?
My insurance company should be the only one concerned with this.

So annoying

I have never done this before I wonder if insurance does it for you. We got hit from behind a couple years ago and I know didn't do it I am assuming my insrunace did. I don't even if I even really looked at the accident report.

Glad I'm not the only one. I wouldn't even think to report to DMV to be honest. What do they have to do with it?

I am thinking that's how carfax maybe gets the information if a car your buying has ever been in an accident? Chat Icon not sure just a guess. I would ask your insurance company if they do it for you.

Carfax gets the data from insurance companies as well as the DMV and police reports. It really depends on how major the accident is. I think the DMV report is for accidents over $1K, not $100.

If you filed a police report, it may be on the car fax. If you went through insurance, it may be on the car fax. I have filed the DMV report in the past, but likely would only do it for a large accident.

I jsut got royally screwed by carfax in that they reported an accident on my car as "structural damage" due to some coding on the insurance companies side. When in reality, it wasn't a big accident and the part replaced related to "frame" was a $75 part. Now I'm stuck begging people to consider my car at thousands less than what the car would go for normally.

Yeah I have to look at the report, maybe it is $1000
But the thing is parts and repairs are so expensive that even though this was minor and we barely felt a jolt, the car needs a new hood, new grill, new fog lights, new bumper becuase he creamed us with a tow hitch.
So it will be well over $1k

I've never ever done this before and everyone I just asked (a group of 4 other ppl) said the exact same thing lol

ETA: I had a car that got hit while it was parked and it was totaled. I received a big check for it. I was never informed I had to file anything with the DMV. Maybe the insurance company does it?

I think the insurance companies handle this for you.

I live in SC and got into my first accident a few months ago when I got hit by a drunk driver that fled the scene. The officer told me to bring the form to the DMV..... and then DMV said the insurance companies usually report it to them. So that website you have may be for the insurance companies that have log ins like mine did. (I have progressive)

I never knew this either. I wonder if you have to report it if you choose not to have the repairs done? Dh was sideswiped several months ago, and has cosmetic damage to the side of his car. A cop came and a police report was filed, but dh chose not to get it repaired since we'd have to pay a deductible and it's a 10 year old car so he didn't feel it was worth it. Wonder if the DMV still needs to know about it?

I never had to do this. I just used to get the police report and call my insurance. Maybe it’s a new thing?

I think its over 1k which has to be reported... which isn't much damage nowadays.... I have never heard of reporting it to the dmv though, just filling a polic report

So as an update. The damage- for this minor fender bender- was over $6K! The guy who backed into us had zero damage as he hit us with his tow hitch.
Parts for this car are apparently quite expensive!

And then, right after I posted this, the insurance company sent us the form we have to fill out for the DMV and instructions to fill it out and send it in.
So I guess your insurance either does it for you or they send it to you to do?

Either way, this report looked EXACTLY like the police report and had that much detail. You even had to draw pictures. DH, who was a cop and is an expert at filling these things out took quite a while working on it.
Why on earth the DMV can't just get a copy of the police report forwarded to them is beyond me. they have no way of knowing if we are lying on that form anyway, Wouldn't it be better to have an official version from the police?

Ah, the inefficiencies and inconveniences of the state!

The report the police wrote for my accident had incorrect information in it. (The weather, number of people in the car, etc).

By submitting your own form you are legally giving a statement (that is supposed to be truthful) discussing your side of the story. To take the cop's word over the people that were actually in the accident would be a mistake.

Right but we gave the cop all the information at the scene and he wrote the report word for word what we said and what the other driver said.
I saw the actual police report and it was verbatim.
If he was lying, how do we prove it? It's then a he said/she said.
I thought the reason for a police report was to get an unbiased report of the accident.
Because the people involved are more likely to lie IMO. The cop has no vested interest in who is at fault.

Hi just wanted to see what you ended up doing about this? On my way home from work today, I was rear ended by another driver. Initially it seemed like my bumper didn’t have much damage and the guy who hit me did, so we filed a police report and the cops gave us one of those driver exchange forms with the statement about filing a report with the dmv on top... initially I thought I wouldn’t be filing a claim but turns out I got home and noticed my sensors were smashed in (when I put the car in reverse it wouldn’t stop beeping) and according to my mechanic my entire bumper now needs to be replaced. I called up his insurance company to file a claim but apparently they have to investigate first to see if their driver is liable before we can move on to getting the estimate/repairs. According to this form any damage above 1k needs to be reported within 10 days... I asked the insurance company and they said they don’t file it...

So a day after I posted this we got a packet in the mail from our insurance company with all kinds of stuff and one was this form. They sent it to us.


So dh filled it out and man was it detailed! He had to draw a diagram of the scene and everything . It was pretty much exactly like the police report (which I got faxed to me after the fact because my insurance co needed it).

So I honestly don't know why the police report can't just be sent to DMV as a procedure. Makes no sense. Double work, but I guess that's the inefficiency of our govt!

But my advice to you, call YOUR insurance company. Let THEM fight with his insurance. They will handle that and get your car fixed and a rental for you ASAP.
As long as the police report says you were rear ended and not at fault they will even get your deductible back and your rates won't go up.
In our accident, the guy put his truck in reverse and floored it into us at a stop sign in front of 2 cops. Clearly not our fault...but we called our insurance and they handled it all...and quickly.

Thank you- yes I did call my insurance and they told me that if I felt that the other driver was at fault then I can just call his insurance this way I wouldn’t have to pay a deductible and get a rental car covered while it’s being repaired, so I went that route..So now the other guys insurance has to investigate before they approve anything. Hopefully I’ll get an estimate soon this way I know whether or not I need to fill out this form ...
