someone explain to me WHY is she only to be sentenced 4 to 12 years????
-bought and used heroin
-sped double the speed limit
-hit a pedestrian and DIDN'T STOP
only 4 to 12 years?????????????
The Stony Brook woman who admitted being high on heroin last year when she struck and killed 11-year-old Courtney Sipes as she crossed the street in Smithtown is to be sentenced Wednesday in Suffolk County Court.
Maureen Lambert, 21, is expected to be sentenced to 4 to 12 years in prison by County Court Judge Stephen Braslow.
Lambert pleaded guilty in October to second-degree manslaughter, second-degree vehicular manslaughter, driving while impaired by drugs and leaving the scene of an accident in connection with Courtney's death on Nov. 24, 2009.
Prosecutors said Lambert had purchased heroin and used it within an hour before striking Courtney as she and her mother and brother were crossing East Main Street in Smithtown.
The force of the impact knocked Courtney out of her shoes, prosecutors said. Lambert fled the scene without stopping, prosecutors said.
When she pleaded guilty, Lambert admitted taking heroin and driving 60 mph - twice the posted speed limit - before the crash.
She admitted that she did not stop and call police and did not surrender to police until more than 26 hours after the fatal collision.

Because that is the way the law is written. I agree, it's awful. But because it's manslaughter and not murder, she wouldn't get the time she really deserves anyway, and also by taking a plea she obviously agreed to a lower sentence (which the judge has to agree to and finalize on her sentencing date).

Disgusting. I have no clue, maybe her lawyer copped to lesser charges? IDK but it is atrocious either way she should absolutely be sentenced to a stiffer punishment.

I don't understand the difference between manslaughter and murder...either way the little girl is gone and this despicable piece of trash is gonna get off easy

I guess it just seems like so many offenses, KWIM?
It's not just speeding and hit someone, it's using heroin, mauling someone, and kept going.
She must have gotten a great lawyer. I didn't think she would get life, but I figured 25 with parole option at 15.

Murder is premeditated, no?
Manslaughter is like....she didn't wake up in the morning and go "I'm gonna drive in my car and kill someone today"
That's the way I understand it anyway. I know there are others who can explain it better.

The intent to kill isn't there with manslaughter.
How ridiculous. That should only imply if you are sober, not driving recklessly and dont leave a little girl to die. She certainly wasnt driving WITHOUT the intent to kill.

That's what I figured too.
I was thinking the same thing. Wouldnt there be additional time for drug possession, driving under the influence, hit and run, etc.

Probably because she pleaded guilty.  Ridiculous. And she didn't just hit a pedestrian but a CHILD which just makes it worse.

I still don't get it; I know difference between murder and manslaughter, but I watch a lot of MSNBC prison programs, and people who went into a liquor store to rob it and shot someone in the arm get much higher sentences, even without prior convictions.
Yeah, she didn't go out and buy her drugs and say, "I'm going to kill someone," but she used heroin, drove car, and sped.
It's not even a hit & run and no drug use.

Then you get into the fact that he was already committing a felony. And the fact that he made the decision to rob the store and shoot someone with a clear mind.
ETA: the charge goes up if you hurt/kill someone while committiing another felony

But isn't buying and using heroin a felony in NY?  ahh the legal system.. confusing & murky.
